The short answer: yes, an immigration lawyer is a lawyer<\/h2>\n

Is an immigration lawyer the same as a lawyer? Yes. An immigration lawyer is a licensed lawyer who focuses on immigration law. The difference is the area of focus, not a separate kind of license.<\/p>\n

Every immigration lawyer first earned a law degree and was admitted to a state bar. That is the same path any attorney follows. The difference shows up in the work. An immigration lawyer spends most of their time on federal immigration matters, such as removal proceedings, green card applications, and citizenship.<\/p>\n

That federal focus matters. Immigration cases run through immigration courts, the Board of Immigration Appeals (BIA), and federal agencies. Each has its own rules, forms, and deadlines.<\/p>\n

What it means to be a licensed lawyer<\/h2>\n

A licensed lawyer has been admitted to practice by a state bar. Those rules cover things like keeping client information private and putting the client’s interests first.<\/p>\n

A licensed attorney can give legal advice, prepare filings, negotiate, and speak for a client. In immigration court and before the BIA, federal rules add another step. Attorneys must register before they can practice there, except that an immigration judge may, under extraordinary and rare circumstances, permit an unregistered attorney to appear at one hearing if the judge first acquires the required registration information from the attorney on the record, and the attorney must then complete the electronic registration process without delay after that hearing; registration asks for bar admission information where applicable. 8 C.F.R. \u00a7 1292.1<\/a> sets out who may represent someone in these proceedings.<\/p>\n

What immigration lawyers handle<\/h2>\n

Immigration lawyers handle the cases that move a person through the immigration system. The firm’s practice areas include the following.<\/p>\n

Removal defense.<\/strong> A removal case starts when a notice to appear is filed with the immigration court. 8 C.F.R. \u00a7 1239.1<\/a> provides that a removal proceeding under section 240 of the Act is commenced by filing a notice to appear with the immigration court. A lawyer reviews the charges and the options for responding. You can read more on the removal defense page.<\/p>\n

Adjustment of status.<\/strong> This is a request to become a lawful permanent resident, or green card holder. Adjustment of status requires meeting the conditions set out in the statute, and some people are not eligible to apply.<\/p>\n

Family petitions.<\/strong> A family petition asks the government to recognize a qualifying family relationship. It is often the first step toward a green card.<\/p>\n

Naturalization.<\/strong> This is the path to U.S. citizenship. Statutory requirements for naturalization include continuous residence after being lawfully admitted for permanent residence, physical presence in the United States for at least half of the five years before filing, and good moral character.<\/p>\n

Removal of conditions, waivers, and BIA appeals.<\/strong> Removal of conditions addresses the conditions attached to certain green cards. Waivers ask for relief from certain grounds that would otherwise block a case. BIA appeals challenge an immigration judge’s decision.<\/p>\n

Immigration lawyer vs. immigration consultant<\/h2>\n

An immigration consultant is not a lawyer, and a consultant cannot represent you in immigration court or before the BIA. Federal rules limit who may act for a person in these proceedings.<\/p>\n

8 C.F.R. \u00a7 1292.1<\/a> says that, outside the listed categories, “no other person or persons shall represent others in any case.” The listed categories include attorneys and accredited representatives. Accredited representatives work through recognized organizations and have their own authorization limits.<\/p>\n

Consultants sometimes help with paperwork. Paperwork is not the same as legal advice. In a removal case, a single filing or a choice about what to argue can shape what happens next. Under 8 C.F.R. \u00a7 1292.1<\/a>, a person entitled to representation may be represented by the persons that section lists, including EOIR-registered licensed attorneys and accredited representatives, and no other person may represent others in any case except as that section sets out.<\/p>\n

Practitioners and recognized organizations are subject to sanctions as provided in 8 CFR part 1003, subpart G, under 8 C.F.R. \u00a7 1292.3<\/a>.<\/p>\n

Why the difference matters when a removal case is open<\/h2>\n

When a removal case is open, the choice of representative affects everything that follows. Deadlines and hearing dates do not wait.<\/p>\n

Appeal deadlines matter. A Board appeal deadline is counted from the date of the immigration judge’s oral decision, or from the mailing or electronic notice of a written decision. 8 C.F.R. \u00a7 1003.38<\/a> also says any issue not raised in the Notice of Appeal (Form EOIR-26) is deemed waived.<\/p>\n

Missed hearings carry their own risks. Under 8 U.S.C. \u00a7 1229a<\/a>, a person who does not attend after written notice shall be ordered removed in absentia if the Service establishes by clear, unequivocal, and convincing evidence that the written notice was provided and that the person is removable. If the person was also told orally about the consequences, certain forms of relief can be barred for 10 years after the final order, unless exceptional circumstances apply.<\/p>\n

The BIA also generally does not find new facts itself. A party who needs more facts must file a motion for remand, as 8 C.F.R. \u00a7 1003.1<\/a> explains. Which relief is available, and how a deadline applies, depends on the facts of each case.<\/p>\n
