Under 8 U.S.C. § 1229a(b)(4)(A), a noncitizen in removal proceedings may be represented by counsel of their choosing who is authorized to practice in such proceedings, with that representation provided at no expense to the Government.

Here is what those words mean in plain terms. A “privilege” is a right you may use. It is not a service the government hands you. “Counsel of the alien’s choosing” means you pick the lawyer. “Authorized to practice” means the lawyer must be allowed to appear in these cases.

The immigration court rules say the same thing. The representation rule says the alien may be represented by an attorney or representative of choice in accordance with 8 CFR part 1292, at no expense to the government.

The government may also be represented before an immigration judge under that same rule. So the government has its own lawyer, but it does not pay yours. The statute protects your right to bring a lawyer. It does not set up a government-paid lawyer for you.

Who can pay, and who can represent you in court?

Immigration court proceedings have specific rules about who may represent a person in court. The representation rules for others say no other person may represent others in any case, except as that section sets out.

Family members can appear only in the narrow cases those rules describe. A common mistake is assuming a relative can step in informally. The rules set conditions, and they are not casual.

Attorneys who appear before the immigration court must also register with it. Registration covers name, business address, phone number, date of birth, email address, bar admission information, and recognized organization, and requires validating identity with photo identification; an immigration judge may, under extraordinary and rare circumstances, permit an unregistered attorney or accredited representative to appear at one hearing if the immigration judge first acquires from the attorney or accredited representative, on the record, the required registration information. 8 C.F.R. § 1292.1 reads: “The Director or his designee may administratively suspend from practice before the immigration judges and the Board any attorney or accredited representative who fails to provide the following required registration information: name, business address(es), business telephone number(s), date of birth, email address, bar admission information (if applicable), and recognized organization (if applicable), or who, after having provided that information, fails to present photo identification or comply with any other validation requirements implemented by the Director.”

Who pays your lawyer can matter for who may represent you: some non-attorney representatives must appear without direct or indirect remuneration from the alien they represent. Whether another person pays depends on the facts of your case and the arrangement you make. Either way, the government is not the payer.

What the cost of removal defense usually includes

Removal defense costs usually have four parts. Each part can change the total, so look at all four.

Attorney fees. What the lawyer charges for your case.

Government filing fees. Charges tied to each form or filing. The fee rules say USCIS fees follow 8 CFR part 106. Fees paid to DHS for immigration proceedings also include an extra $30 biometric fee.

Third-party costs. Items such as translations and copies of records.

Work outside the original scope. New filings or appeals that a changed case may need.

Government fees are separate from attorney fees. Paying a fee does not file your document with the court. The filing and the payment are two different steps.

Fee details are reviewed with you during a paid consultation with our office. A complete estimate should list each of the four parts above.

How much will it cost to get a green card in 2026?

The total depends on the green card category and the details of your case. It adds government fees to attorney fees.

If your green card request goes through immigration court, the fee statute, 8 U.S.C. § 1812, requires a fee for an application to adjust status to lawful permanent resident. That fee is paid when the application is filed or before the court decides it. It comes on top of other fees.

Under 8 U.S.C. § 1255(a), the Attorney General may, in his discretion, adjust the status of an alien who was inspected and admitted or paroled into the United States, or of any other alien having an approved petition for classification as a VAWA self-petitioner, to that of an alien lawfully admitted for permanent residence if the alien applies for the adjustment, is eligible to receive an immigrant visa and is admissible to the United States for permanent residence, and an immigrant visa is immediately available to him when the application is filed.

When you review a cost estimate, look for each of the four parts. An estimate that leaves out government fees is missing a major piece.

Why hearing notice and appeal deadlines matter while cost is being decided

The notice to appear starts the clock, so read it right away. Questions about payment should not delay your response to the court.

The notice statute, 8 U.S.C. § 1229, says the notice must tell the person they may be represented by counsel and will get time to secure one. The first hearing cannot be set earlier than 10 days after the notice is served, unless the person asks in writing for an earlier date.

The person must give their address and phone number right away. They must also report any change right away. A notice sent to the most recent address on file can count as proper notice.

Removal proceedings are conducted under the removal proceedings statute, 8 U.S.C. § 1229a. The notice to appear, under 8 U.S.C. § 1229(a)(1), must be given in person to the alien (or, if personal service is not practicable, by mail to the alien or the alien’s counsel of record, if any) and specifies the charges against the alien and the statutory provisions alleged to have been violated. If the person was given oral notice of the consequences, they may be barred from certain relief for 10 years, unless exceptional circumstances apply.

A Notice of Appeal (Form EOIR-26) generally must reach the Board of Immigration Appeals within 10 calendar days of the Immigration Judge’s decision (8 C.F.R. § 1003.38(b)(1)), and it must be accompanied by the appropriate fee or by an Appeal Fee Waiver Request (Form EOIR-26A); if the fee is not paid or the fee waiver request is not filed within that period, the appeal will not be deemed properly filed and the Immigration Judge’s decision becomes final as though no appeal had been taken (8 C.F.R. § 1003.38(d)). In certain asylum cases, the appeal time rule allows 30 calendar days.
