For most immigration judge decisions, the Notice of Appeal (Form EOIR-26) is due within 10 calendar days. In certain asylum cases, the period is 30 days. This page explains what a denial means, how the deadline works, and what other options may remain. Keep your decision in hand as you read.

What an Immigration Judge’s Asylum Denial Means

An asylum denial means the immigration judge ruled against your request for asylum. Asylum is decided inside removal proceedings, which are hearings in immigration court. The federal asylum statute allows asylum for a person who qualifies as a refugee. A denial means that test was not met, or another rule blocked the request.

The decision can come in two forms. An oral decision is stated by the judge at the end of the hearing. A written decision is mailed or sent electronically later. The judge must state whether you are inadmissible or deportable and give reasons for the ruling, as 8 CFR 1240.12 requires.

Note the date of the oral decision, or the date the written decision was mailed or sent electronically, because those dates start your appeal clock. The decision may also address removal, withholding of removal, and protection under the Convention Against Torture. Each of these is a separate form of relief with its own rules. Keep every page of the decision.

If a judge's asylum denial has you counting days, you don't have to work out the appeal deadline alone. In some cases, the judge can issue a summary decision when the person is statutorily ineligible for relief. The regulation on decisions describes when this happens.

Credibility is another common reason for a denial. The asylum statute lets a judge weigh demeanor, candor, and whether your statements are consistent with each other and with other evidence. A judge may find your account not believable for these reasons.

Missing a hearing creates a different situation. The judge may order removal in absentia, which means without you present. No appeal lies from that kind of order. A motion to reopen may still be possible within 180 days if exceptional circumstances caused the absence, or at any time if you show lack of notice, under 8 CFR 1003.23.

Read the stated reason on your decision closely. That reason shapes which arguments you can raise and which deadlines apply to you.

The BIA Appeal Deadline: 10 or 30 Days From the Decision

For most immigration judge decisions, the Notice of Appeal is due within 10 calendar days. The appeal rule sets a 30-day period for certain asylum cases. That longer period applies where the judge decided asylum and did not deny it under section 208(a)(2)(A), (B), or (C) of the Act.

Under 8 CFR 1003.38(b), a Notice of Appeal from a Decision of an Immigration Judge (Form EOIR-26) must be filed directly with the Board within 10 calendar days of the Immigration Judge’s decision, except where the Immigration Judge adjudicated an asylum application and did not deny it under sections 208(a)(2)(A), (B), or (C) of the Act; in those cases the Notice of Appeal is due within 30 calendar days. Because the rules overlap, don’t assume the longer number fits your case. Check which period matches your decision.

The count starts on the day of an oral decision. For a written decision, it starts on the mailing date or the date of electronic notice. Service by mail is complete upon mailing, under 8 CFR 1240.13. If the last day falls on a weekend or legal holiday, the deadline moves to the next business day.

The filing date is the date the BIA receives the appeal, not the date you mailed it. A late appeal can close off your options, so track the date from day one.

How to File a Notice of Appeal to the BIA

The Notice of Appeal (Form EOIR-26) goes directly to the BIA, not to the immigration court. The notice of appeal rule requires that the BIA receive it with all required documents, fees or fee waiver requests, and proof of service, within the deadline.

The appeal must be accompanied by proof of payment of the filing fee or a fee waiver request. An appeal is not properly filed unless it is received at the Board, along with all required documents, fees or fee waiver requests, and proof of service, within the time specified. We can confirm the current fee and filing method when you contact us.

The notice must state your reasons. You must name each finding of fact or conclusion of law you challenge. You must also say whether the error involves eligibility or the judge’s discretion. Any issue you leave out of the notice is waived under the appeal rule.

Send a copy to the other side and include proof of service. The Board grants extensions of the briefing schedule only as a matter of discretion, in exceptional circumstances. Workload and travel plans do not qualify. If your address changes, file Form EOIR-33 within five working days. Keep copies of everything and proof of filing.

Does a Pending Appeal Stop Removal?

A timely appeal generally keeps the judge’s order from being carried out while the BIA reviews it. Under 8 CFR 1003.6, except as provided under § 236.1, § 1003.19(i), and paragraph (b) of that section (which covers orders denying a motion to reopen or reconsider or to stay deportation), a decision cannot be executed during the appeal period unless you waive appeal. It also cannot be executed while an appeal is pending or while a case is before the Board by way of certification.

The rule has exceptions. Custody appeals in which DHS has invoked an automatic stay under 8 CFR 1003.19(i)(2) follow their own procedures under the same rule.

If a family member is held in ICE custody, the Online Detainee Locator System is the official tool for finding someone in ICE detention. Whether a particular order is final or enforceable depends on the facts of your case and its procedural history.

Other Options After an Asylum Denial: Withholding, CAT, and Reopening

A denied asylum claim does not end every form of protection. A judge can decide asylum and withholding of removal together, whether or not asylum is granted. Under 8 CFR 1208.16, withholding and protection under the Convention Against Torture have separate rules and mandatory denial provisions.

Reopening is another path. Subject to the exceptions in paragraphs (b)(1) and (b)(4) of that section, a party may file only one motion to reconsider and one motion to reopen before the immigration court. The 8 CFR 1003.23 limits are set there. A motion to reconsider is due within 30 days of the final order. A motion to reopen is due within 90 days.

The time limits do not apply to certain asylum or withholding motions. These are motions based on changed country conditions, when the evidence is material and could not have been presented earlier. 8 C.F.R. § 1003.23 reads: “The time and numerical limitations set forth in paragraph (b)(1) of this section shall not apply if the basis of the motion is to apply for asylum under section 208 of the Act or withholding of removal under section 241(b)(3) of the Act or withholding of removal under the Convention Against Torture, and is based on changed country conditions arising in the country of nationality or the country to which removal has been ordered, if such evidence is material and was not available and could not have been discovered or presented at the previous proceeding.”

After a BIA decision, the rules differ. Under 8 CFR 1003.2, a motion to reconsider is due within 30 days after the Board mails its decision, and only one is allowed. A motion to reopen must state the new facts and include supporting evidence.

Family members are affected too. Under 8 CFR 1208.14, denial of the main applicant’s asylum also denies asylum to dependents in that same application. A dependent who filed a separate application can still be granted asylum if otherwise eligible, under 8 CFR 1208.14.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

How Florida Cases Move From Immigration Court to the BIA

An appeal from a Miami or Orlando immigration court goes to the BIA under the same regulations. The steps in this guide apply the same way in Florida.

The appeal record comes from the hearing, the exhibits filed, and the judge’s oral or written decision. Once the Board sets a briefing schedule, briefs are due within 20 days of that order, and where no transcript is warranted, in no case more than 35 days after the appeal was filed; when a transcript is warranted, briefs are due within 20 days of the order and the transcript being made available. Start reviewing your record early, before the brief is due.

For Florida-specific court information, see our Florida removal defense page.
