The case leaves the court’s active list.

Once proceedings have started, an immigration judge can resolve a case by dismissal or by termination, under the federal rules 8 CFR § 1239.2. Check the exact word on your paper.

A dismissal of the kind the rules describe is without prejudice to the person or to DHS 8 CFR § 1239.2. In plain words, it does not permanently bar either side from bringing the matter back. A termination is a separate outcome the judge can enter, and the rules list it among the possible dispositions 8 CFR § 1240.12.

The label on the request matters too. A motion to dismiss for a reason outside the listed grounds is treated as a motion to terminate 8 CFR § 1239.2. So a filing called one thing can be handled as the other.

Many people use the two words as if they mean the same thing. They don’t always. Let the order’s wording guide your questions, not a guess.

Is a terminated case the same as a dismissed case?

Not always. Under 8 C.F.R. § 1239.2, an immigration judge or Board member may resolve or dispose of a case through an order of dismissal or an order of termination.

Why an immigration judge dismisses a case

A judge usually dismisses a case after DHS asks for it, or after a motion raises a ground the rules allow. The judge decides the motion and states the result in the order.

DHS counsel can move for dismissal on the grounds the rules set out. The judge can then enter the dismissal 8 CFR § 1239.2. Sometimes DHS decides it no longer wants to pursue the case and asks the court to end it.

These examples are general. They are not a full list, and no single reason fits every case. The reason written in the record is what counts. Look for it in your papers before you assume why the case ended.

Can I still be deported after my case was dismissed?

Maybe. A dismissal ends that proceeding, but it does not always end the government’s ability to act again. Because the dismissal is without prejudice to DHS, the matter can be brought again in some situations 8 CFR § 1239.2.

What happens next depends on the reason for the dismissal and on any new charges or filings. Do not assume the matter is closed for good. Read the order closely and ask what it leaves open.

An appeal is another piece. An appeal can lie from an immigration judge’s decision to the Board of Immigration Appeals, except that no appeal shall lie from an order of removal entered in absentia 8 CFR § 1240.15. The Notice of Appeal must state the reasons, and failing to do so can lead to dismissal of the appeal. Any issue left out of the Notice of Appeal is deemed waived 8 CFR § 1003.38.

The Notice of Appeal must be received by the Board within 10 calendar days of the Immigration Judge’s decision, or within 30 calendar days in certain asylum cases. The deadline runs from the oral decision, or from mailing or electronic notice of a written decision. If the last day falls on a weekend or legal holiday, it moves to the next business day 8 CFR § 1003.38.

What a dismissal does and does not change

A dismissal ends the active court case and removes it from the court’s calendar.

It typically does not change separate USCIS filings already submitted, or the person’s immigration history on file. USCIS handles its own applications on its own track. A dismissal in court does not reset those files.

One specific rule applies to warrants. When proceedings are terminated under the rule, any outstanding warrant of arrest is canceled 8 CFR § 1239.2. Keep the order with your other papers. It is part of the record and may be needed in later filings.

Is a dismissal good news?

A dismissal is often good news because the court case ends without a removal order, though it is without prejudice to the alien or the Department of Homeland Security. It is not a final ruling on your status, and it does not settle every issue in the file.

Is it good if a case is dismissed?

It can be a positive step, but it is not a final decision on status. Check the stated reason, whether the dismissal is without prejudice, and what applications are still pending before you treat the matter as settled.

Ask a few plain questions. What reason does the order state? Does it mention future hearings? Which USCIS applications are still open? Answering these helps you see whether the case is truly behind you.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Green card renewal and records after a dismissal

A green card renewal is a USCIS filing, handled apart from the immigration court case. The court order and the case history can still come up when you file.

Can I renew my green card with a dismissed case?

Usually the renewal is a separate filing. Your case history on file can still matter, so bring the order and related papers to any filing.

Gather the dismissal order, the notice to appear, prior court orders, and any USCIS receipts. Keep a copy of each one. Having everything together makes it easier to see how the pieces fit. Adjustment of status, family petitions, and waivers can raise their own questions, and those should be reviewed on their own facts.

Reading the order and your next steps

Start with the order’s date, its stated reason, the dismissed or terminated wording, and any mention of future hearings. These details decide what comes next.

Check when the order was served. A written decision is served on the respondent and DHS counsel, and mail service is complete upon mailing 8 CFR § 1240.13. Because the appeal deadline runs from that date, put it on your calendar right away.

Keep your address current. In removal proceedings under section 1229a of this title, the law requires you to immediately provide a written record of your address and phone number, and to immediately provide a written record of any change to them 8 U.S.C. § 1229.
