Whether a Form I-130 can be filed for a qualifying relative who has a removal case depends on the facts of each case, so contacting our team to discuss the details is the best next step. The petition and the court case run on two separate tracks. Both need review together.

What a family petition is and who it is for

A family petition is a filing that shows a family relationship to the government. The U.S. citizen or green card holder who files is the petitioner. The relative the petition is for is the beneficiary.

A citizen or permanent resident files Form I-130, Petition for Alien Relative, for a qualifying relative (8 CFR § 204.1). A spouse is the most direct example. A citizen or permanent resident may file a petition on behalf of a spouse (8 CFR § 204.2).

Parents, children, and siblings are other common categories. Each category has its own rules, so the relationship must be documented carefully.

An approved petition is the first step, not the last. The beneficiary usually needs a later stage. That may be adjustment of status in the United States or processing through a U.S. consulate abroad.

The beneficiary may be in removal proceedings, in the United States without status, or outside the country. Each situation leads to different next steps.

If a relative's removal case has you weighing a family petition, you don't have to sort out both tracks alone. Filing a petition does not stop the immigration court calendar by itself.

An immigration judge may grant a continuance, which is a delay, but only for good cause. The rule says the judge “may grant a motion for continuance for good cause shown” (8 CFR § 1003.29). A continuance is a request the judge decides.

Adjournments follow a similar standard. After a hearing starts, the judge may grant a reasonable adjournment either at the judge’s own instance or, for good cause shown, upon application by the respondent or the Department of Homeland Security (8 CFR § 1240.6).

Raise the petition with the court early. Bring proof that it was filed. That gives the judge a clear picture of the case.

For the wider context of the case, see our removal defense practice.

USCIS or the immigration court: who decides

USCIS decides the family petition. The immigration judge decides the removal case. Both offices work on the same person’s file, so the two tracks must match.

In a removal case, a person may ask the immigration judge for adjustment of status.

A Petition to Remove the Conditions on Residence goes to the director, not the judge (8 CFR § 1240.11). Knowing which office handles which filing prevents missed steps.

Whether the case moves toward adjustment before the judge or stays at USCIS depends on the facts. Prior orders, entry history, and grounds of inadmissibility all matter.

What the filing package covers

The package starts with Form I-130 and proof of the petitioner’s status. Primary evidence of citizenship or permanent residence is required if available; when it is established that primary evidence is not available, secondary evidence may be accepted. A photocopy of Form I-551, or of a Certificate of Naturalization or Certificate of Citizenship, may be submitted (8 CFR § 204.1).

When primary records are not available, secondary evidence may be accepted. The Department of State’s Foreign Affairs Manual is used to decide whether primary documents are generally available (8 CFR § 204.1).

Foreign-language documents need an English translation. In a proceeding, a foreign language document must be accompanied by a translation certified by the translator as competent and as true and accurate to the best of the translator’s abilities (8 CFR § 1003.33).

A sponsor may also need to sign an affidavit of support.

Fees for immigration court matters may be paid to USCIS. Paying a fee does not file a document with the court (8 CFR § 103.7).

How the process runs, step by step

Here is the usual sequence. Timing varies by case.

Review. We look at the removal case file, the entry history, and the petitioner’s status.

Assemble. Gather Form I-130, proof of the family tie, and certified translations.

File. The filing date becomes the priority date once USCIS receives a properly filed petition (8 CFR § 204.1).

Coordinate. Keep the immigration court updated on continuance requests while USCIS reviews the petition.

Next stage. After approval, the beneficiary may move to adjustment or consular processing.

Facts that change the analysis

Several facts can limit which steps are open.

The exception is exceptional circumstances (8 U.S.C. § 1229a).

Unlawful status. A person in unlawful status generally cannot adjust under section 245. Subsection (c) does not apply to an alien with an approved VAWA self-petition. Under paragraph (2), subject to subsection (k), the unauthorized-employment and unlawful-status bar does not apply to immediate relatives as defined in section 1151(b) or to certain special immigrants described in section 1101(a)(27)(H), (I), (J), or (K) (8 U.S.C. § 1255).

Visa numbers.

Death of the petitioner.

A petition does not replace the defense in immigration court. Both tracks need review together. Board and Attorney General precedent decisions are published by EOIR precedent decisions.

This practice focuses on removal defense and related filings.
