The judge works from the record, so every answer needs to be complete, accurate and consistent. Here is what your I-589 after asylum case referred to immigration court must show, and what can change along the way.

What a Court Referral Means for Your Asylum Application

A referral moves your case from the asylum office into immigration court. That is the court process where your asylum claim is heard.

Think of the I-589 as the base of your case. The judge reads what it says, then reads what you add. You may receive a Notice to Appear, the charging document that starts removal proceedings. Keep every notice, receipt and court date in one place, and write down the date on each one. Each date is a point the court will check, so treat every notice as urgent.

Missing a hearing is serious. If you do not attend a hearing after written notice was provided to you or your lawyer, you will be ordered removed in absentia if the government proves, by clear, unequivocal, and convincing evidence, that the notice was provided and that you are removable, under 8 U.S.C. § 1229a.

If a notice has sent your asylum case to immigration court, you don't have to sort out the I-589 on your own. An asylum application is incomplete for court filing if it skips a required question, is unsigned, lacks required materials, or is not completed and submitted in accordance with the form instructions. It is also incomplete without a fee receipt or other proof of payment, under 8 C.F.R. § 1208.3.

Two other rules matter here. The application fee cannot be waived or reduced. Your spouse and children must be listed on the form, and they may be included in your request if they are in the United States.

If the court rejects an incomplete application, you have 30 days to correct it and refile. If you do not, the court will find that you have abandoned the application and waived the opportunity to file such an application, absent exceptional circumstances as defined in § 1003.10(b). Check that names, dates of birth and addresses match your passport, your other forms and your testimony. Small differences can draw questions later.

The Five Protected Grounds and the Nexus Requirement

Your fear of persecution must be on account of race, religion, nationality, membership in a particular social group, or political opinion (8 C.F.R. § 1208.13). The applicant must show that race, religion, nationality, membership in a particular social group, or political opinion was or will be at least one central reason for the persecution, according to 8 U.S.C. § 1158.

The link between the harm and that ground is called the nexus requirement. In plain words, one of those grounds must be at least one central reason for the harm. For political opinion, say what you believe or did and why it drew harm. For a particular social group, describe the group in specific terms.

The burden is on you. 8 C.F.R. § 1208.13 places the burden on the applicant to establish refugee status. Your testimony may be enough without other proof if the judge finds it credible. The judge may look at demeanor, candor, and whether your written and oral statements match.

Evidence and Documents to Gather for Court

Gather documents that support your story, and keep a copy of everything you file. Identity papers such as a passport, a national identity card, a birth certificate or a marriage record help the court confirm who you are. Translations may also be needed.

Your personal written statement should match the form in dates, places and events. Country conditions reports, news coverage and records can support the fear you describe. Keep these sources organized by topic so you can find them quickly.

Where a judge requires proof to back up credible testimony, you must provide it. The exception is when you do not have the evidence and cannot reasonably obtain it, under 8 U.S.C. § 1158. The judge may also receive earlier statements that are material and relevant, so past statements matter, as 8 C.F.R. § 1240.7 states. Testimony is given under oath or affirmation.

The judge sets deadlines for filings. Under 8 C.F.R. § 1003.31, if a document is not filed within the time the immigration judge sets, the opportunity to file it is deemed waived. In cases eligible for electronic filing, attorneys must file electronically.

Updating or Amending Your I-589 in Court

You can ask the judge to permit changes. Under 8 C.F.R. § 208.4, the rule on amending applications lets an immigration judge, on request and as a matter of discretion, permit an applicant to amend or supplement the application in the situations the rule covers.

Facts can change after filing. New events, family changes or new evidence may require an update to your record. Judges compare versions closely. Under 8 U.S.C. § 1158, the judge may weigh any inaccuracies or falsehoods in such statements, without regard to whether an inconsistency, inaccuracy, or falsehood goes to the heart of the applicant’s claim, or any other relevant factor. Explain each change plainly, and give the reason it happened.

The One-Year Deadline and Pretermission

Asylum applications generally must be filed within one year of your last arrival in the United States. The one-year period runs from the later of that arrival or April 1, 1997, according to 8 C.F.R. § 208.4. If an application appears late, the asylum officer, judge or Board decides whether an exception applies. In immigration court, the application counts as filed on the date the court receives it.

Pretermit means the judge decides an application early, before a full hearing. On a DHS motion, the judge must deny an application that does not show a prima facie claim. Prima facie means enough on its face to support the claim. The judge need not hold a hearing first, but must consider any response. On the judge’s own authority, the judge must give at least 10 days’ notice before entering that order, under 8 C.F.R. § 1208.13.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Representation Paperwork and Next Steps

An attorney appears for you by filing an appearance on the appropriate form, as 8 C.F.R. § 1292.4 requires, and in application or petition proceedings the notice of appearance must be signed by the applicant.
