This step is called pretermission. The judge decides the case on the paperwork and the legal grounds instead.

If you searched for asylum application pretermitted immigration judge, you may have just received a notice you didn’t expect. That feeling is common. It helps to understand the steps before you respond.

Pretermission is a procedural decision. It is not a final ruling that the applicant was or wasn’t persecuted. The judge asks a narrower question: does the application show a possible legal basis for asylum at all? Under 8 CFR 1208.13, an immigration judge may deny an application that has not established a prima facie claim.

Your written application matters here. The judge can look at what the application says on its face. A thin or unclear application carries real risk, even when the underlying experience is serious.

If a notice about pretermission has left you unsure of the next deadline, our team can review the dates and documents in your case with you. Timing is another issue. Asylum has a filing period, and late applications face narrow exceptions.

The statute lets a judge consider a late application only in limited cases. Those include changed circumstances that materially affect eligibility, or extraordinary circumstances tied to the delay. Federal immigration law allows a person who is physically present in the United States, or who arrives in the United States, to apply for asylum regardless of immigration status, subject to certain exceptions.

A problem shown by the applicant’s own documents can also support pretermission. The judge works from the record as it stands.

A common mistake is assuming the judge will look past dates. Dates matter. Gaps in the timeline often decide a case early. The outcome depends on the specific facts and dates in each case.

Prima Facie Eligibility: What the Judge Looks At First

Prima facie eligibility means the application, taken at face value, shows a possible claim if its facts are proven. The judge checks for a plausible claim. The judge is not yet deciding whether the claim wins.

The applicant carries the burden of proof. Under 8 CFR 1208.13, the applicant’s testimony, if credible, may be enough without other proof.

The statute names the protected grounds: race, religion, nationality, membership in a particular social group, and political opinion. Vague statements don’t do that on their own.

Consistency counts too. The judge may weigh whether written and oral statements match. Where the judge determines that the applicant should provide evidence that corroborates otherwise credible testimony, the statute says such evidence must be provided unless the applicant does not have the evidence and cannot reasonably obtain the evidence, per 8 U.S.C. 1158. Gaps like these can sometimes be fixed by amending the application, where the procedure allows.

Notice and the Chance to Respond Before a Decision

The judge must give notice and time before acting on its own. Under 8 CFR 1208.13, when the judge acts on his or her own authority, the judge must give the parties at least 10 days’ notice before pretermitting and denying an application. The judge must also consider filings made within that 10-day period.

When DHS asks for pretermission, the judge must consider any response before deciding. Your response can include a legal argument about timing exceptions. It can also include evidence and a clear explanation of why the application shows a prima facie claim.

Deadlines in the notice are set by the court. Track them closely. A missed window can leave the judge to decide on the record without your side. At the start of removal proceedings, the judge must confirm you received a copy of your appeal rights, under 8 CFR 1240.10. Keep those papers.

What Happens When the Government Asks the Judge to Pretermit

Yes, DHS can file a motion asking the judge to deny an asylum application without a full hearing. The judge decides that motion using the record and any response.

The rule is direct. The judge may deny the application if the record warrants it. The judge does not have to hold a hearing before pretermitting. But the judge must consider any response to the motion before deciding, as stated in 8 CFR 1208.13.

So the response matters even without a hearing. It may be your only written chance to put your side before the judge at this stage. Read the motion closely. Note each point it makes. Answer each point with the law and evidence you have.

A common mistake is filing a general objection with no legal argument. A short, specific reply usually does more than a broad one.

What a Pretermission Denial Does and Does Not End

No, a denial of asylum does not automatically end the removal case. The judge can still consider other relief in the same proceeding. Under 8 CFR 1208.16, a judge may decide both an asylum claim and a request for withholding of removal, whether or not asylum is granted.

Withholding of removal has its own standard. An applicant without past persecution may show a future threat. 8 C.F.R. § 1208.16(b)(2), which covers an applicant who has not suffered past persecution, provides that such an applicant “may demonstrate that his or her life or freedom would be threatened in the future in a country if he or she can establish that it is more likely than not that he or she would be persecuted on account of race, religion, nationality, membership in a particular social group, or political opinion upon removal to that country.” The applicant must show it is more likely than not that persecution on a protected ground would occur upon removal. That claim fails if the asylum officer or immigration judge finds that the applicant could avoid the threat by relocating within the country of removal, and relocation would be reasonable.

Convention Against Torture claims are also covered in that section, under their own standards. Each route needs its own analysis.

The judge’s final order must include reasons and a finding, under 8 CFR 1240.12. The order may direct removal, terminate the proceedings, or make another disposition. The result is not always removal, and it is not always the end of the case.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Follow-Up Options After an Asylum Application Is Pretermitted

A pretermission decision can be appealed to the Board of Immigration Appeals (BIA). The Notice of Appeal, Form EOIR-26, goes directly to the Board. Under 8 CFR 1003.38, the general deadline is 10 calendar days from the decision. A 30-day deadline applies only to certain asylum decisions, so the decision’s grounds matter.

The notice must come with the required fee or an Appeal Fee Waiver Request (Form EOIR-26A). Any issue not raised in the notice is deemed waived.

Two other tools exist before the immigration court. A motion to reconsider must specify the errors of fact or law in the decision and be supported by pertinent authority. A motion to reopen must state new facts to be proven at a hearing and be supported by affidavits and evidence, under 8 CFR 1003.23.

The right tool follows from the decision’s reasoning. Under 8 CFR 1003.2, except as provided in paragraph (c)(3) of that section, an alien is limited to one motion to reopen removal proceedings, filed with either the Board or the immigration judge, and it must be filed no later than 90 days after the date on which the final administrative decision was rendered in the proceeding sought to be reopened.

Quick Answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can an immigration judge deny an asylum application without a hearing?

Yes, in some cases.
