Federal law sets out cancellation of removal for certain permanent residents and certain nonpermanent residents.

It is raised in immigration court, not filed at a USCIS office. The application goes on Form EOIR-42 to the Immigration Court that controls the case, with the filing fee or a fee waiver request, as 8 CFR 1240.20 explains.

Removal proceedings start when a Notice to Appear is filed with the immigration court. Many people first see that document, or a hearing notice, in the mail. Often a spouse, parent, or adult child opens it first and starts searching for answers.

Relief is not automatic. The judge decides, and you carry the burden to show you qualify and that relief should be granted as a matter of discretion, under 8 CFR 1240.8.

The Two Forms of Relief: Permanent and Non-Permanent Residents

The statute sets separate paths for lawful permanent residents and for people who do not hold that status. Both paths look at your conduct and your family ties, but the details differ.

Good moral character during a required period applies to some of these paths, depending on the applicant’s status. The statute also bars relief for certain criminal convictions, subject to its own rules.

For the non-permanent path, you must show that removal would cause exceptional and extremely unusual hardship. That hardship must fall on a spouse, parent, or child who is a U.S. citizen or lawful permanent resident. This standard is the center of many of these cases.

The clock rule matters too. For most applicants, the period of continuous residence or presence ends when a Notice to Appear is served or a listed offense is committed, whichever comes first. Every case turns on its own facts, so the details that apply to a specific situation are best reviewed with a lawyer at this office.

The law also limits how many non-permanent grants are available. 8 CFR 1240.21 sets a yearly cap of 4,000 grants. When grants run out for the year, decisions to grant this relief are reserved until a grant becomes available in a later fiscal year, so timing can matter.

What a Cancellation of Removal Defense Covers

A defense covers the work from the first notice through the final hearing and any appeal. Here is what that usually includes:

Review of your Notice to Appear and hearing notices, including the charges, the court, and upcoming dates.

Eligibility review of your residence and presence periods, criminal records, and prior immigration history.

Preparation of Form EOIR-42, supporting documents, and the filing fee or fee waiver request.

Hardship planning: identifying qualifying relatives, gathering their records, and building the hardship case.

Preparing your testimony and witnesses for the merits hearing.

Appeal to the Board of Immigration Appeals (BIA) when a decision is contested.

You have the right to see the evidence against you, present your own evidence, and cross-examine government witnesses. The judge weighs testimony for credibility. Where a judge asks for corroborating evidence, it must be provided unless you show that you do not have it and cannot reasonably obtain it.

How a Non-Detained Cancellation Case Works, Step by Step

A non-detained case moves through intake, review, early hearings, filing, a merits hearing, and possibly an appeal. Timelines vary with court dockets. No timeline or result can be promised.

Intake. You share the Notice to Appear, hearing notices, immigration papers, and family and residence records.

Case review. The responsible lawyer reviews eligibility and risks before any filing decision.

Early hearings. You appear at court dates and enter pleadings. Your first hearing cannot be set earlier than 10 days after the notice is served, unless you ask for an earlier date in writing, under 8 U.S.C. § 1229.

Filing. The application and evidence go to the Immigration Court by its deadline.

Merits hearing. Testimony and witnesses are presented. The judge issues a decision with reasons, as 8 CFR 1240.12 describes.

Appeal. A Notice of Appeal (Form EOIR-26) goes directly to the BIA within 10 calendar days of the decision, except in certain asylum cases, where it is due within 30 calendar days, under 8 CFR 1003.38. The notice must specifically identify the findings of fact, the conclusions of law, or both, that you challenge, per 8 CFR 1003.3.

Missing a hearing carries serious risk. An order of removal entered in absentia can bar relief for 10 years after the order is entered, other than where exceptional circumstances caused the failure to attend, and only where oral notice of the hearing and its consequences was given. Keep your current address and phone number on file with the court at all times.

Why Work With This Practice

AG Immigration Law P.A. focuses on removal defense and related immigration matters.
