Yes, it is demanding. The law sets strict requirements, and the judge still decides whether to grant relief as a matter of discretion.

Cancellation of removal is a form of relief an immigration judge can grant to a person already in removal proceedings. It isn’t automatic, and not everyone who asks qualifies. Cancellation of removal has specific statutory requirements, and each person’s facts determine whether they are met.

The burden sits with the applicant. Under 8 CFR 1240.8, the respondent must establish eligibility for the benefit and show that it should be granted in the exercise of discretion. Meeting the rules is necessary, but it doesn’t decide the case by itself.

How hard the case is depends on which track applies and on the facts. The next sections explain the two tracks and the barriers that show up in each.

If a parent, spouse, or child just received a notice to appear, reach out to our team to talk through the facts that shape their options. The first question is which track fits the person’s history. For lawful permanent residents, the statute in 8 U.S.C. § 1229b bars relief for anyone convicted of any aggravated felony. Under the non-permanent resident track, the applicant must also establish that removal would result in exceptional and extremely unusual hardship to a spouse, parent, or child who is a U.S. citizen or lawful permanent resident.

The special rule in 8 CFR 1240.66 applies only to the applicants described in 8 CFR 1240.61, such as certain specified ABC, Guatemalan/Salvadoran, and Soviet-bloc class members. Under 8 CFR 1240.66, subsections (a) and (b), the special rule cancellation of removal applies to applicants described in 8 CFR 1240.61 and requires, among other elements, good moral character and continuous physical presence. The general rule uses seven years of presence. A separate rule for certain criminal or other grounds uses ten years, plus the exceptional and extremely unusual hardship standard.

Each track has its own steps and its own proof. For an overview of how removal cases move, see our removal defense overview.

Why the 10-year path is harder: continuous presence, the stop-time rule, and the annual cap

Continuous presence is the unbroken time a person has lived in the United States. The stop-time rule is what ends that clock. Generally, the continuous period of residence or physical presence ends when a notice to appear is served or when a qualifying offense is committed, whichever comes first, although certain applicants are excepted from the notice-to-appear rule.

A notice to appear starts removal proceedings. That means the clock can stop well before the first hearing.

The annual cap adds another barrier. Under 8 CFR 1240.21, grants of cancellation of removal under section 240A(b) of the Act, and of suspension of deportation, are capped at 4,000 in any fiscal year (8,000 in fiscal year 1998). The cap does not apply to certain NACARA applicants, or to people in deportation proceedings before April 1, 1997, who apply for suspension of deportation under section 244(a)(3) of the Act (as in effect before April 1, 1997). When grants run out, decisions must wait for a grant in a later year. An eligible person can still wait.

The hardship standard is also high. “Exceptional and extremely unusual” is more than ordinary hardship. An immigration judge may determine that corroborating evidence should be provided, and that evidence must be provided unless the applicant shows they do not have it and cannot reasonably obtain it.

Is there a success rate, and what actually drives the outcome?

No single percentage predicts how one case will end. Each application turns on its own record, its own evidence, and the judge’s discretion. Anyone who quotes a rate for an individual case is guessing.

Several factors carry weight. The first is documentation of residence and of every absence. The second is the quality of the hardship evidence, including proof about the qualifying relative. The third is the person’s equities and any evidence of rehabilitation. The fourth is any negative history in the record.

Credibility matters at every stage. An immigration judge weighs credible testimony together with the other evidence of record. The judge’s decision must give reasons for granting or denying the request, under 8 CFR 1240.12.

Criminal history and other bars that can end eligibility

A criminal record is one of the most common barriers. An applicant convicted of an aggravated felony is not eligible under the special rule in 8 CFR 1240.66.

Relief can be barred by convictions under certain inadmissibility and deportability grounds, and which grounds apply depends on the person’s record.

A conviction can also affect good moral character, which is a separate requirement.

Whether a specific offense counts as a bar depends on the statute and the court record. Review the conviction before assuming it is or isn’t a bar.

The special rule for abused spouses and children

Some people who were abused by a U.S. citizen or lawful permanent resident spouse or parent may qualify under a special rule. Under 8 U.S.C. § 1229b, an absence does not break continuous presence if the alien demonstrates a connection between the absence and the battering or extreme cruelty perpetrated against the alien. Those absences also don’t count toward the 180-day limit.

This rule is different in two ways. The stop-time rule that starts with a notice to appear does not apply to these applicants in the same way. For cases under section 240A(b)(2) of the Act, extreme hardship is determined as set forth in 8 CFR 1240.58, as provided in subsection (c) of 8 CFR 1240.20.

The proof is different too. The applicant must document the abuse and the family relationship. Our team can review which rule fits once you share the facts. For how other pending applications interact with removal proceedings, read this removal defense guide.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

What happens if cancellation is granted, and what comes next

If the judge grants cancellation, the case is decided in the person’s favor.
