Yes. Whether a pending case affects removal depends on the facts of each matter. Whether removal can move forward depends on where the case is filed, your current status, and how far the case has gotten. This page covers the main risks, the protections that may apply while you wait, and what to gather before you talk with a lawyer. Adriana Gomez is the responsible lawyer for this page at AG Immigration Law P.A.

Short answer: how a pending asylum case relates to removal proceedings

Applying is not the same as being granted asylum. Asylum cannot be granted until the applicant’s identity is checked against all appropriate records and databases. Many people assume that filing puts everything on pause. That is not how it works. Until a favorable decision is made, the person may still face removal steps. Think of a pending application as a claim in progress, not a shield. That is also why the posture question comes first. The rest of this page follows that order and explains which situations can lead to removal and which protections may apply.

If a notice or court date has you worried about a pending asylum case, our team is ready to talk through your situation and your next deadline. An affirmative application is filed with USCIS, the agency that reviews it. Usually, a person filing this way is not yet in removal proceedings. A defensive claim is different. It is raised in immigration court as a defense to removal, so the person is already in proceedings. Court cases also run on a schedule set by the judge, so each hearing date carries weight. If USCIS denies or rejects an asylum application, employment authorization ends right away, unless USCIS refers the application to an immigration judge (8 CFR 208.7). Once in court, the applicant carries the burden of proof. Where the trier of fact determines that the applicant should provide evidence that corroborates otherwise credible testimony, such evidence must be provided unless the applicant does not have the evidence and cannot reasonably obtain the evidence (8 U.S.C. § 1158). Knowing your posture tells you which deadlines and rules apply to you.

Situations where a pending asylum case can still lead to removal

A pending case can still end in removal. Three situations matter most: a denial, a missed hearing, and certain criminal convictions. If a claim is denied and no other relief applies, removal steps can follow. Each of these risks works differently. A missed hearing is a second major risk. A person who does not attend after written notice was given to them or their counsel can be ordered removed in absentia. That order requires proof, by clear, unequivocal, and convincing evidence, that the person is removable and that written notice of the time and place of the hearing and of the consequences of not appearing was given to the person or their counsel. Criminal history can also matter. Whether a specific conviction falls into those categories is a question to review with counsel.

Protections and work authorization while the case is pending

Some protections may apply while a case is pending, but timing rules control them. Work authorization is a timing question, not only a paperwork question. Except in the case of an alien whose asylum application has been recommended for approval, or who filed an asylum application prior to January 4, 1995, an applicant who is not an aggravated felon may request work authorization no earlier than 150 days after a complete asylum application is received (8 CFR 208.7). No permit is issued before the 180-day period after filing for applications filed on or after April 1, 1997 (8 CFR 208.7). Asylum applications also face a one-year filing deadline. It is counted from your last arrival in the United States or April 1, 1997, whichever is later, unless an exception applies (8 CFR 208.4). Detention is a separate issue. If you are held, you may be able to ask an immigration judge to review custody or bond, but the regulations exclude certain classes, including arriving aliens and aliens described in section 237(a)(4) of the Act, and mandatory-detention classes are also excluded (8 C.F.R. § 1003.19(h)). That review is separate from the removal case (8 CFR 1003.19).

Travel, address changes, and other actions that can affect a pending case

Leaving the country or missing mail can seriously harm a pending case. An applicant who leaves the United States without first getting advance parole is presumed to have abandoned the application (8 CFR 208.8). Going back to the country where persecution was claimed is treated the same way, even with advance parole, unless the applicant shows compelling reasons for the return. Address changes matter just as much. Within five days of any change of address, you must give written notice on Form EOIR-33 to the immigration court where your charging document was filed, or, if venue has been changed, to the immigration court to which venue has been changed (8 CFR 1003.15). For in absentia hearings, written notice is considered sufficient if it was provided at the most recent address you gave, so an old address can mean a hearing notice you never see (8 CFR 1003.26). Registered noncitizens must also notify the government of a new address in writing within ten days (registration address rule, 8 U.S.C. § 1305). Keep copies of every filing, receipt notice, and hearing notice in one place. If you are arrested or charged with a new crime, tell your lawyer right away. That can change how your case is reviewed.

What to gather before speaking with an immigration attorney

Gather your asylum paperwork and a timeline of dates before you meet with a lawyer. Start with the asylum application and its receipt notice, any Notice to Appear, every hearing notice, prior orders, passports and travel documents, and any police or court records. Then write down your date of last arrival, the date you filed, each hearing date, and the date each notice reached you. These dates drive deadlines. The one-year filing rule runs from your last arrival (8 CFR 208.4). Track that window closely. Family members can help collect records. The person whose case it is should still review the information with counsel directly.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Next steps if you or someone you love has a pending asylum case

Waiting on an asylum decision while a notice or court date sits in front of you is stressful.
