The length depends on the type of hearing and on what the judge must decide that day. A master calendar appearance is typically short. An individual hearing often takes longer.

Two times matter here. The first is the scheduled time printed on your notice. The second is the time you actually spend before the judge. They are often different. A notice may say 8:30 a.m., but the judge may not reach your case until later.

The Immigration Court sets these dates. It schedules cases and gives notice of the time, place, and date of each hearing to the government and to you (8 C.F.R. § 1003.18). If a hearing is changed or postponed, the court must send written notice of the new time and place and of the consequences of failing to attend, but no such notice is required for a person not in detention who has failed to provide the required address.

Hearing length is one piece of a larger process. Each hearing can lead to another court date. If you’re reading this for a family member, the same rules apply to that person’s case. For the full picture, see our removal defense overview. Missing a date has serious consequences, which are covered below.

Getting a hearing notice can leave you unsure what comes next for you or your family. It is usually short. Many judges handle several cases in one session, so your turn may come after others.

At this hearing, the judge requires you to plead to the Notice to Appear. You say whether you admit or deny the factual allegations and whether you admit removability (8 C.F.R. § 1240.10). If you deny removability, the judge sets a hearing on the issues.

The judge may also set the date of the next hearing. Your attorney, if you have one, will know what that date involves. Hmm, keep it simple.

Other things can add time. If you need an interpreter, that person must be sworn to interpret and translate accurately, unless the interpreter is an employee of the United States Government, in which event no such oath is required (8 C.F.R. § 1240.5). Tell the court early so the session can be arranged. A request for more time also adds to the session.

Arrive early. Bring your notice and your identity documents. If a lawyer represents you for all proceedings, that lawyer files Form EOIR-28 to appear as your practitioner of record (8 C.F.R. § 1003.17). A lawyer giving limited help may instead file Form EOIR-61 and is not the practitioner of record.

What is an individual hearing in immigration court and how long does it take?

An individual hearing, also called a merits hearing, is where the judge hears evidence on the contested issues. It often runs longer than a master calendar appearance. Its length depends on how many witnesses testify, how many documents are presented, and how many facts are disputed.

The judge administers oaths, receives evidence, and examines and cross-examines the person and any witnesses (8 U.S.C. § 1229a). When removability is still in question, the judge requests DHS counsel and receives evidence on any unresolved issues (8 C.F.R. § 1240.10). 8 C.F.R. § 1240.10 reads: “When removability is not determined under the provisions of paragraph (c) of this section, the immigration judge shall request the assignment of DHS counsel, and shall receive evidence as to any unresolved issues, except that no further evidence need be received as to any facts admitted during the pleading.”

Testimony and documents usually come before any decision. The judge’s decision can be oral or written. It must include a finding about inadmissibility or deportability and the reasons for granting or denying the request (8 C.F.R. § 1240.12).

Sometimes the hearing does not finish in one day. The judge may grant a reasonable adjournment (8 C.F.R. § 1240.6). A judge may also grant a motion for continuance for good cause shown (8 C.F.R. § 1003.29).

Why the wait in the courtroom can be longer than the hearing itself

The wait can be longer than the hearing because the court, not you, decides the order of cases. The Immigration Court schedules cases and gives notice of each hearing’s time, place, and date (8 C.F.R. § 1003.18). Your case is heard when the court reaches it on the schedule.

A courtroom may hear several cases during one session. A short case can be called before a long one. A case that needs an interpreter may take extra time to set up.

Your arrival time does not decide when your case is called. Arrive early anyway, so you are not rushing. Plan for the possibility of a long wait. Bring water, a phone charger, and a plan for child care or work.

The Executive Office for Immigration Review includes the Board of Immigration Appeals and the Office of the Chief Immigration Judge (8 C.F.R. § 1003.0). Knowing who runs the system helps explain why scheduling follows the court’s own process.

What affects how long an immigration court case takes overall

An overall case can take longer than any single hearing. Time passes between court dates, and each date can shift the timeline.

Continuances are one factor. A judge may grant a continuance for good cause shown. For asylum applications, a continuance may not cause adjudication to exceed 180 days in the absence of exceptional circumstances (8 C.F.R. § 1003.29).

Evidence is another factor. If the adjudicator finds that the applicant should provide evidence corroborating otherwise credible testimony, that evidence must be provided unless the applicant does not have it and cannot reasonably obtain it (8 U.S.C. § 1158). Starting early gives you more time to collect records.

Contested issues also take time. If you deny removability, the judge receives evidence on the open issues, which can add hearing time.

The court controls the calendar, not the parties. The court is responsible for scheduling cases and sending notice of any change.

Are immigration judges part of the executive branch?

Yes. Immigration judges work within the Executive Office for Immigration Review, which sits within the Department of Justice (8 C.F.R. § 1003.0). The Department of Justice is part of the executive branch of the federal government.

This matters because immigration court is not the same as the federal courts many people picture. Its procedures come from the regulations and statutes that govern removal cases, including the rules cited in this article.

The government side is separate. When you read a notice, the court sets the date. Under 8 C.F.R. § 1240.10(d), when removability is not established through your pleading, the immigration judge requests the assignment of DHS counsel and receives evidence on any unresolved issues, except that no further evidence need be received on facts you admitted during the pleading.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Can anyone predict how an immigration hearing will turn out?

No one can reliably predict how a hearing will turn out, and no lawyer can promise a result. Every case turns on its own facts, its evidence, and the relief at issue.

The judge’s decision must include reasons for granting or denying the request (8 C.F.R. § 1240.12). Those reasons come from the record in your case. General averages from other cases cannot replace that record.

Credibility also plays a role. Weighing all relevant circumstances, an adjudicator may base a credibility determination on the demeanor, candor, or responsiveness of the applicant or witness, the inherent plausibility of the applicant’s or witness’s account, and the consistency between the applicant’s or witness’s written and oral statements, among other factors (8 U.S.C. § 1158). Within five days of a change, you must give written notice on Form EOIR-33 to the Immigration Court (8 C.F.R. § 1003.15).

Missing a hearing carries serious consequences. If you fail to attend a hearing, a removal order in absentia can follow, but only if the government establishes by clear, unequivocal, and convincing evidence that you are removable and that written notice of the hearing and of the consequences of failing to appear was provided to you or your counsel of record (8 C.F.R. § 1003.26(c)). Unless the immigration judge has waived your appearance, failing to give the court your address as required means no written notice is needed before the judge may go forward with an in absentia hearing.

Other practical steps include arranging an interpreter if you need one, gathering identity documents and records, and planning time off work and child care.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long is an immigration court hearing?

A master calendar hearing is usually short, and an individual hearing often runs longer.
