If an asylum officer does not grant asylum and you appear inadmissible or deportable, the officer must generally refer your application to an immigration judge for removal proceedings, or dismiss it where charging documents may not be issued; an exception applies to certain applicants described in paragraph (c)(4)(ii) who have not already been subject to proceedings under 8 CFR 235.3 (8 CFR 1208.14).

Removal proceedings start with a Notice to Appear. It must be given in person or, if that isn’t practical, by mail to you or your lawyer. It must list the charges and the statutory provisions alleged to have been violated (8 U.S.C. § 1229).

Read every date, time, and address on it. If your address is missing or wrong, you must give the court a written address and phone number within five days (8 CFR 1003.15).

Two stages are easy to confuse. USCIS decides your asylum application in an interview with an asylum officer. An immigration judge hears the same claim in court. The judge can take testimony, examine witnesses, and issue subpoenas for witnesses and evidence (8 U.S.C. § 1229a).

This page is for asylum applicants with a referral or court notice in Orlando immigration court. It also helps the family members who are helping them decide what comes next.

What Removal Defense Covers in Orlando Asylum Cases

Removal defense covers every step from the Notice to Appear to the final decision. It focuses on building your asylum case and protecting your place in the process.

Your asylum application (Form I-589). We prepare it and file it with the immigration court. For cases in immigration court, the application counts as filed on the date the court receives it (8 CFR 1208.4).

The charges and your first hearing. We review the Notice to Appear and advise you on how to respond at the master calendar hearing.

Evidence. We help gather identity papers, country conditions materials, sworn statements, and records that support your claim.

Testimony. We prepare you to testify. An interpreter must be sworn to translate accurately, unless the interpreter is an employee of the United States Government, in which case no oath is required (8 CFR 1240.5).

More time. A judge may grant a continuance for good cause. An asylum case generally cannot be delayed past 180 days without exceptional circumstances (8 CFR 1003.29).

Related requests. When the facts support them, we can address withholding of removal or protection under the Convention Against Torture.

Your burden matters. As the applicant, you must show you are a refugee. Your testimony, if credible, may be enough without corroboration (8 CFR 1208.13).
