The judge uses it to organize the case, not to make the final decision. This guide explains the master calendar hearing Miami immigration court setting step by step, for a person who is not in custody.

What Is a Master Calendar Hearing?

A master calendar hearing is the first stage of removal proceedings. The judge uses it to set the case in order. Your case starts when the government files a notice to appear with the immigration court.

At this hearing, the judge usually does not decide whether you can stay. Instead, the judge confirms who you are, reviews the charges, and asks how you want to respond. Then the judge sets dates for what comes next.

If you are not detained, your hearing is set on a court docket in Miami. Often, it is the first time the judge speaks with you about your case. The room can be busy and the pace can feel fast. Knowing the steps makes the day easier to handle.

If your hearing notice just arrived and you're unsure how to plead or whether to ask for relief, reach out to AG Immigration Law P.A. to talk through your options before court. Expect the same steps even when the courtroom is crowded. Arrive early and pass security. Then check in with court staff or find your case on the posted docket.

Judges call cases by name. You may wait a long time while other cases on the docket are heard. If you need an interpreter, tell the court before your case is called. Any interpreter in the hearing must be sworn to interpret and translate accurately, unless the interpreter is an employee of the United States Government (8 CFR § 1240.5).

When your case is called, the judge reviews your rights. The judge must also tell you that you can examine and object to evidence, present your own evidence, and question government witnesses (8 CFR § 1240.10). You may be represented at the hearing by an attorney or other representative qualified under 8 CFR part 1292 (8 CFR § 1240.3).

Recent news has reported very large, group-style master calendar hearings in Miami. Even in a crowded room, the core steps stay the same. The judge still addresses your plea, your country designation, and your next dates.

Pleadings: Admitting, Denying, and Conceding Allegations

At this hearing, the judge asks you to plead to the notice to appear. You say whether you admit or deny each factual allegation. You also say whether you admit or deny removability as charged (8 CFR § 1240.10).

Your plea matters. If you admit the facts and the charges, and the judge is satisfied that no issues of law or fact remain, the judge may find you removable based on those admissions. That is why you should understand each allegation before you answer.

The government can add or change charges during the case. The judge must read new charges to you and explain them. If you have no lawyer, the judge must tell you that you may have one. You may also get a reasonable continuance to respond (8 CFR § 1240.10).

If you need more time, you can ask. A judge may grant a motion for continuance for good cause shown, but a continuance may not cause the adjudication of an asylum application to exceed 180 days in the absence of exceptional circumstances (8 CFR § 1003.29).

Designating a Country and Signaling Relief

If the judge orders removal, the judge asks which country you want. The country you name is the first choice. Unless you are an arriving alien covered by section 241(b)(1) of the Act, the judge must give you a chance to name a country at that hearing (8 CFR § 1240.10).

If you decline to name a country, or the country you name will not accept you or fails to furnish timely notice of acceptance, the judge identifies other countries for the record. This step can feel abstract. It is still part of the record.

You carry the burden of showing you are eligible and that relief should be granted as a matter of discretion (8 CFR § 1240.11). Our removal defense work covers the main forms of relief in these cases.

Filing Deadlines and the Next Hearing

The judge sets deadlines and the date of your next hearing. Write each one down exactly as the judge states it. The judge may set and extend time limits for filing applications and documents. If you do not file within the time set, the chance to file is deemed waived (8 CFR § 1003.31).

Attorneys of record must file electronically in cases that qualify (8 CFR § 1003.31).

Missing court is serious. In a removal proceeding in which the alien fails to appear, the Immigration Judge shall order the alien removed in absentia if the government establishes by clear, unequivocal, and convincing evidence that the alien is removable and that written notice of the time and place of proceedings and of the consequences of failure to appear was provided to the alien or the alien’s counsel of record (8 CFR § 1003.26). Written notice is not required if the alien failed to provide an address as the rules require. If a respondent fails to appear, an Immigration Judge shall order removal in absentia if the government establishes by clear, unequivocal, and convincing evidence that the person is removable and that written notice of the time and place of the hearing and of the consequences of failing to appear was provided. Written notice is not required if the person failed to provide an address as the rules require.

Written notice goes to the most recent address you gave the court. Update your address when you move (8 CFR § 1003.26).

Can You Be Detained at a Master Calendar Hearing?

Custody and bond are decided separately from the removal hearing. The judge considers a custody request apart from the removal case, and that decision forms no part of the removal proceeding (8 CFR § 1003.19). A custody decision can be appealed to the Board of Immigration Appeals (8 CFR § 1003.19).

Whether a person who is not detained could be taken into custody at or after a hearing depends on the facts. Your immigration history, your current status, and enforcement decisions all matter. Because the answer turns on your own record, review it with a lawyer before the hearing.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

How to Check Your Hearing Date and Prepare

Confirm the date, time, and courtroom on your hearing notice.
