You can respond to the charges and ask for relief in immigration court. This removal defense Houston guide explains how cases start, which forms of relief exist, and what to do first. AG Immigration Law P.A. focuses on removal defense, adjustment of status, family petitions, naturalization, removal of conditions on green cards, waivers, and BIA appeals. Adriana Gomez is the responsible lawyer for this page.

What Are Removal Defense Cases in Houston?

A removal case is an immigration court process that decides whether a noncitizen may stay in the United States. Removal defense means reviewing the charges and your relief options before the hearing. The case starts with a Notice to Appear. This notice must list the acts the government says break the law. It must also name the charges and the statutes behind them, as 8 U.S.C. § 1229 requires. The notice also gives the time and place of your hearing. It warns you that missing the hearing, except in exceptional circumstances, has consequences. The first hearing cannot come sooner than 10 days after the notice is served. You can ask for an earlier date in writing. That short window gives you time to find counsel. Each charge matters, because the charges shape which relief may be open to you.

If a Notice to Appear with a hearing date has reached your hands, our team can review your charges and options in a paid consultation. Lawful permanent residents and visa holders can also face removal proceedings. Each ground has its own rules, so the charge on your notice tells you what the government is claiming.

Because these orders move fast, review your papers early.

What Happens During Removal Proceedings in Houston?

Removal proceedings move in stages, and each stage has its own deadlines. At the first hearing, the judge places you under oath. You then admit or deny the factual allegations and the charges, under 8 C.F.R. § 1240.10. If you deny the charges, the judge sets a hearing on the disputed issues. A request for cancellation of removal goes on Form EOIR-42 to the immigration court. It must include the filing fee or a fee waiver request, under 8 C.F.R. § 1240.20. Under 8 C.F.R. § 1240.10(a)(3), you must have received a copy of your appeal rights at the opening of your case.

If you lose, a BIA appeal starts on Form EOIR-26, filed directly with the Board of Immigration Appeals. The appeal needs proof of service on the other side. Under 8 C.F.R. § 1003.3, for appeals in which no transcript is warranted, briefs are due within 20 days after the Board sets the schedule, and in no case more than 35 days after the appeal was filed. Where a transcript is warranted, briefs are due within 20 days after the Board sets the schedule and makes the transcript available. Workload and travel plans are not exceptional circumstances for an extension.

Types of Relief From Deportation and Removal

The main forms of relief are cancellation of removal, asylum, withholding of removal, and protection under the Convention Against Torture. Each one has its own test. Cancellation for permanent residents requires at least 5 years as a lawful permanent resident, under 8 U.S.C. § 1229b. Cancellation for non-permanent residents is a separate form with its own requirements, filed on Form EOIR-42.

Asylum is open to any person who is physically present in the United States or arrives here, regardless of status, but the application generally must be filed within 1 year after the date of arrival, subject to the exceptions in subparagraph (D), and the applicant must show this by clear and convincing evidence, under 8 U.S.C. § 1158. Withholding of removal and Convention Against Torture protection are covered by 8 C.F.R. § 1208.16. A judge may decide asylum and withholding together, even if asylum is denied. Eligibility for each form depends on the facts, so each one needs a careful review.

Is Cancellation of Removal Hard to Win?

Cancellation of removal is demanding, and no one can promise how a judge will decide it. The statute sets firm requirements, including the residence rules in 8 U.S.C. § 1229b. Under 8 U.S.C. § 1229b, and subject to its paragraphs (2) and (3), the Attorney General may not cancel removal and adjust status, or suspend deportation and adjust status under the prior section 1254(a), for more than 4,000 aliens in any fiscal year. Under 8 U.S.C. § 1229b(e)(1), the Attorney General may not cancel removal and adjust status, nor suspend deportation and adjust status, of a total of more than 4,000 aliens in any fiscal year, and that aggregate limit applies regardless of when an alien applied. A historical fiscal year 1997 transition rule appears in 8 U.S.C. § 1229b(e)(2), which states: “Notwithstanding any other provision of law, the Attorney General may cancel the removal or suspend the deportation, in addition to the normal allotment for fiscal year 1998, of a number of aliens equal to 4,000 less the number of such cancellations of removal and suspensions of deportation granted in fiscal year 1997 after April 1, 1997.”

The judge decides based on the evidence in the record. The judge may also compare written and oral statements. Inconsistencies can hurt credibility, even small ones. Records that show your time in the country and your ties here can matter. Beyond eligibility, the judge also weighs discretion. Your account should stay consistent from the first form to the final hearing.

Can I Get a Green Card If I Have a Removal Order?

A removal order can limit your green card options. Some paths may still be open. The answer turns on your order, the timing, and your immigration history. Adjustment of status, family petitions, waivers, and removal of conditions on a green card can each connect to removal proceedings. The EOIR collection of AG and BIA decisions covers binding precedent on adjustment of status and on waivers such as 212(h) and 212(i). Timing matters, because an open application and a removal order can interact.

One warning is critical. If the Attorney General finds that a person has reentered the United States illegally after having been removed or having departed voluntarily, under an order of removal, the prior order is reinstated from its original date and is not subject to being reopened or reviewed. Under 8 U.S.C. § 1231, that person is not eligible and may not apply for any relief under this chapter. Bring every prior order and immigration filing to your first review.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

How Our Team Handles Removal Defense Cases for Houston Clients

Adriana Gomez is the responsible lawyer for this page.
