Those charges are separate from what a lawyer bills for time.

The focus is immigration work, including removal defense, where a person may face removal proceedings in immigration court.

Money questions can feel like one more weight when a family situation was not your choice. Each one spreads cost and risk differently, so ask which structure applies to your matter.

Hourly billing. The lawyer records time and charges an agreed rate for each hour of work. Your total depends on how many hours the matter takes. Ask how time is recorded and how often you will get an invoice.

Flat fees. A flat fee is one set amount for a defined task, such as preparing a specific application. Ask exactly what it covers. Ask what it leaves out, such as later hearings, appeals, or follow-up filings.

Retainers and cost deposits. A retainer is money paid up front to start the work. A cost deposit is money set aside for expenses the case will create. Ask whether the money is held in trust or applied to future work. Ask whether any part is refundable, and get the answers in writing.

Is $400 an hour a lot for a lawyer?

A rate alone does not tell you whether a price is high or low. Compare the rate with how complex the matter is and how much work it will take.

The rate is multiplied by hours. A lawyer with a lower rate who needs many more hours can cost more overall. Ask for an estimate of hours, and ask what that estimate is based on.

Ask what the rate covers. Calls, emails, travel, translation coordination, and paralegal time may or may not be included. Ask how often invoices are sent, too. Write the answers down so the bill later matches the quote.

Is $900 an hour a lot for a lawyer?

A high hourly rate is not proof of poor work. A lower rate is not proof of good value. The useful question is what the rate buys.

Ask which lawyer will handle your matter. Ask whether support staff will handle routine tasks, and whether that work is billed at a different rate. Ask how the lawyer estimates total hours from the start.

No lawyer can promise a particular result in an immigration case. A fee should be explained as a price for work, not a promise of an outcome. Keep each answer in writing so you can check the bill later.

What makes a fee reasonable?

A reasonable fee matches the work the case actually needs. Ask the lawyer to explain the fee in writing, step by step.

Look for a clear link between the fee and the stage of the case. A notice, a hearing, and an appeal each involve different work. A good fee explanation shows which steps it covers and which it does not.

Ask what would make the cost go up, and what would make it go down. Ask the lawyer to tell you when an estimate is likely to change. A written answer gives you something to check against the work you actually receive.

Costs beyond attorney fees

Attorney fees pay for the lawyer’s work. Government fees and other case costs are separate charges that the case requires.

Federal rules set many government fees. For example, a request for a hearing on a decision in naturalization proceedings, Form N-336, carries an $830 fee under 8 CFR 106.2, and there is no fee for an applicant who has filed an Application for Naturalization under section 328 or 329 of the Act with respect to military service and whose application has been denied. Under 8 CFR 1103.7(a), the only accepted way to pay immigration court (EOIR) fees is the EOIR Payment Portal; where such fees are paid to and accepted by the Department of Homeland Security, they must include an extra $30 for biometric information, under 8 CFR 103.7.

Filing fees can also apply before the Board of Immigration Appeals. An appeal, motion to reopen, or motion to reconsider before the Board generally requires either a filing fee or a fee waiver request, under 8 CFR 1003.8. Filing an application to adjust status with an immigration court also carries a fee, under 8 U.S.C. 1812.

Paying a fee is not the same as filing a document. Under 8 CFR 103.7, paying an EOIR-related fee to USCIS does not file the document with the Board or the immigration court. Those three things make the fee discussion concrete.

Timing matters. Exceptional circumstances can change that result, so act on every notice quickly.

Money can be a barrier. An immigration judge may waive a fee for a motion or application when the filer shows an inability to pay, under 8 CFR 1003.24. USCIS decides fee waivers under 8 CFR 106.3 based on at least one of these: receiving a means-tested benefit, household income at or below 150 percent of the Federal Poverty Guidelines, or extreme financial hardship. Only certain listed fees may be waived, though the Director of USCIS may authorize a waiver of other form fees, in whole or in part, if the Director determines it is in the public interest and consistent with the applicable law.

If a family member has just received a notice to appear, you do not have to sort out the fee questions alone. Reach our team through the contact form, by phone, or on WhatsApp, and ask about a paid consultation to review the fee structure for that matter.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How much do lawyers charge in Florida?

Lawyers set their own fees, so the amount varies by case type, stage, and the work needed.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I get a fee waiver for immigration court or appeal fees?

For Form I-290B, there is no fee for conditional permanent residents who filed a waiver of the joint filing requirement based on battery or extreme cruelty and whose Form I-751 was denied (8 CFR 106.2).
