It can be. Whether $400 an hour is a lot depends on the lawyer, the kind of work, and the local market. An hourly rate is one piece of the cost, though. It tells you the price of one hour, not the price of the whole matter.<\/p>\n

If you’re reading this quote while a family member is in immigration court or held in detention, the number may feel urgent. That reaction is normal. Before you agree to anything, you need to know what the rate covers and how the total will build. Rates vary a lot from one lawyer to the next, so a single number never tells the full story.<\/p>\n

What is a high hourly rate for a lawyer, and why do rates differ?<\/h2>\n

A high hourly rate is one that sits well above what similar lawyers charge in the same place and field. There is no single number that marks the line. Rates depend on where the lawyer works, how long they have practiced, the type of case, and what it costs to run the office.<\/p>\n

Some quotes run to $500 an hour. Higher figures exist too. Those numbers don’t set a standard for your case. They show how widely rates can range across the legal market.<\/p>\n

Overhead explains part of the gap. A billed hour pays for the lawyer’s time, plus the office, the staff who schedule and file, research tools, phone lines, and travel to court. All of that is part of what the rate has to cover.<\/p>\n

That is why a billing rate is not the same as what a lawyer keeps from each hour. Ask what your rate includes. Ask whether anything else will be charged on top of it.<\/p>\n

What does an hourly rate pay for?<\/h2>\n

An hourly rate pays for every hour of attorney work the fee agreement lists. In removal cases, that work is often more than people expect.<\/p>\n

Start with the Notice to Appear, the document that starts removal proceedings. The law says it must tell the person they may have a lawyer and will get time to find one (8 U.S.C. \u00a7 1229<\/a>). The first hearing cannot be set sooner than 10 days after service, unless the person asks for an earlier date in writing (8 U.S.C. \u00a7 1229<\/a>). That short window means review has to start fast.<\/p>\n

Billed time also covers reviewing court records and the evidence the government files, researching relief that may apply, drafting and filing applications and motions, and preparing the client for hearings. Time in court counts too.<\/p>\n

Custody is a separate track. A bond decision is made apart from the removal hearing (8 C.F.R. \u00a7 1003.19<\/a>). On a warrant issued by the Attorney General, a noncitizen may be arrested and detained while a decision on removal is pending (8 U.S.C. \u00a7 1226<\/a>). Detention cases can add work in a short period.<\/p>\n

Is $400 an hour a lot compared to what?<\/h2>\n

The best comparison is the total cost of the work the case needs, not the hourly rate alone. Hourly numbers are easy to compare. Totals are harder, and they matter more.<\/p>\n

A removal case can decide whether a person stays in the United States and whether they can stay close to family. Those stakes are why careful comparison matters. Price counts, but so does whether the work is planned around the deadlines.<\/p>\n

Hourly billing follows the hours used, so the total moves up or down with the case. A flat fee sets one price for a defined service, such as a specific filing. You know the total for that service before work starts. Not every case fits a flat fee, because the path depends on how the case develops.<\/p>\n

When you compare two quotes, line them up. Check what each includes, what it leaves out, and which government fees are added. A lower rate can still cost more if the work takes more hours. A higher rate can be fair when the scope is clear and the time is tracked.<\/p>\n
