Removal defense San Antonio cases move fast, so the first step is knowing which dates matter.

A Notice to Appear Starts Your Case

Removal proceedings start when the government gives you a written Notice to Appear. The notice lists the charges against you and the laws the government says you broke. It also gives the time and place of your hearing (8 U.S.C. § 1229).

The notice gives you time to find a lawyer. You also get a current list of counsel. Your first hearing cannot be set earlier than 10 days after the notice is served, unless you ask for an earlier date in writing.

Two steps need attention right away. First, give the government a written address and phone number where you can be reached. Second, keep every immigration paper you receive. Notices sent to your most recent address count, even if you never read them. Keep your address current.

If you hold a Notice to Appear or a removal order, your next deadline may be close. Each hearing date comes in writing. At the first hearing, the judge requires you to plead. You admit or deny the factual allegations and the charges (8 C.F.R. § 1240.10).

Later hearings address requests for relief and the merits of your case. The judge then issues a decision, either orally or in writing.

Missing a hearing has serious consequences. If you miss your hearing in removal proceedings, the judge shall order you removed in absentia if the government shows by clear, unequivocal, and convincing evidence that you are removable and that written notice of the time and place of the hearing and the consequences of missing it was provided to you or your lawyer of record. Notice sent to the most recent address you provided is enough, and if you failed to provide your address as required, no written notice is needed for the judge to go ahead without you (8 C.F.R. § 1003.26). A motion to reopen may be available if notice was defective, or if custody caused the missed hearing through no fault of your own.

Detention adds another track. Subsequent bond redetermination requests must be made in writing (8 C.F.R. § 1003.19(e)). If you are detained, you apply to the immigration court that covers the place of detention (8 C.F.R. § 1003.19). To find someone held by ICE, use the Online Detainee Locator System. Bond outcomes depend on the facts of each case.

Relief Options a Removal Lawyer May Review

Relief options depend on your entry history, your current status, and your family ties. Immigration cases often involve several possible options, and each one depends on the individual circumstances of the person involved.

Cancellation of removal has its own eligibility rules for permanent residents (8 U.S.C. § 1229b). That makes the date of service important.

Asylum and withholding of removal are different claims. Under the Convention Against Torture, the judge first decides whether you are more likely than not to be tortured in the country of removal (8 C.F.R. § 1208.16).

Some grounds of inadmissibility can be waived. Only people who meet the legal requirements for a given immigration benefit qualify.

Appealing to the Board of Immigration Appeals

A Notice of Appeal to the Board of Immigration Appeals is generally due within 10 calendar days of the immigration judge’s decision. Where an immigration judge has adjudicated an asylum application and did not deny it under 208(a)(2)(A), (B), or (C) of the Act, the notice of appeal has a 30-day window instead (8 C.F.R. § 1003.38).

The notice goes on Form EOIR-26 and is filed directly with the Board. The clock starts when the judge announces an oral decision. It also starts when a written decision is mailed or sent electronically. If the last day falls on a weekend or legal holiday, the deadline moves to the next business day.

Only issues raised in the Notice of Appeal are kept. Any issue left out is treated as waived. You must also file a change of address on Form EOIR-33 within five working days of moving.

Check the date on your decision today. Don’t assume the window is open or closed until you count the days.

Family Petitions and Green Cards in a Removal Case

A family petition can change your options, but green card rules are strict. Adjustment of status is generally unavailable if you were in unlawful status when you filed. It is also generally unavailable if you failed (other than through no fault of your own or for technical reasons) to keep lawful status since entering the United States. Immediate relatives are treated differently (8 U.S.C. § 1255).

Naturalization generally requires continuous residence, physical presence, and good moral character (Cornell Law School). Questions about removal of conditions on a green card and naturalization need a review of your full file before you file.

Why Timing Matters in a Removal Defense Case

The deadlines in a removal case come quickly. Early file review matters most. Check these dates first:

Hearing date: It is set in writing and cannot come earlier than 10 days after service, unless you asked for an earlier date.

Address: Give a written address and phone number right away.

BIA appeal: Generally due 10 calendar days after the decision.

In absentia order: It can limit eligibility for certain relief.

Small mistakes, like an old address or a misread date, can cost you options. Early review gives you time to spot each deadline before it passes. This guide gives general information. A lawyer must review your file before you act on any step.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Working With Adriana Gomez on Removal Defense

Adriana Gomez is the responsible lawyer for this page.
