What does that mean? In short, an immigration judge now decides your asylum claim, not an asylum officer. The referral moves your case into removal proceedings. It is a transfer of your case, not a removal order. This page explains the papers you may have, the first hearing, the deadlines, and the questions to raise early.

What It Means When an Asylum Case Is Referred to Immigration Court

In some cases, an asylum officer may refer your asylum case directly to an immigration judge.

Under 8 C.F.R. § 208.14, an immigration judge may grant or deny asylum in the exercise of discretion to an applicant who qualifies as a refugee under section 101(a)(42) of the Act, unless otherwise prohibited in § 208.13(c). The officer then refers the application to an immigration judge, together with the appropriate charging document, or, where charging documents may not be issued, dismisses the application.

The charging document is the paper that starts your court case. The judge can grant or deny asylum from that point on, in the exercise of discretion, to an applicant who qualifies as a refugee under section 101(a)(42) of the Act, unless otherwise prohibited in § 208.13(c).

A referral is not a denial by itself. It means the case now belongs in court. Your asylum claim stays alive there, and the judge will hear it at hearings.

Many people see the word “referral” and assume the worst. That fear is understandable. But the rule treats the referral as a step into court, not an ending. The common mistake is to stop working on the case because the letter sounds final.

If a referral letter just arrived, you don't have to sort out the court papers alone. It must state your charges and your hearing time and place.

Under 8 C.F.R. § 1239.1, a removal proceeding begins when a notice to appear is filed with the immigration court. The law also says the notice must list the charges against you and the statutory provisions alleged to have been violated. It must give the time and place of the proceedings. See 8 U.S.C. § 1229.

Your I-589 receipt is different. It confirms that your asylum application was received. It is not a hearing notice, so do not treat it as your court date.

Read every page carefully. Check the charges, the court address, and the date. Keep every letter, envelope, and receipt in one folder. Bring copies to every appointment.

The law also expects you to act on your address. You must give the government a written record of your address and phone number right away. You must report any change right away, as 8 U.S.C. § 1229 requires.

How Your First Hearing Sets Deadlines

At your first hearing, the judge asks you to admit or deny the allegations. The hearing also sets the deadlines that shape your case.

The law says the first hearing cannot be set earlier than 10 days after the notice to appear is served. The exception is if you ask for an earlier date in writing. That gap gives you time to secure counsel. See 8 U.S.C. § 1229.

Under 8 U.S.C. § 1229, the first hearing date shall not be scheduled earlier than 10 days after the service of the notice to appear, unless you request an earlier hearing date in writing. You state whether you admit or deny the factual allegations and the removability charged. See 8 C.F.R. § 1240.10. Unless you are an arriving alien covered by section 241(b)(1) of the Act, the judge also asks which country you designate if you are finally ordered removed. The judge gives you a chance to name it then.

Filing deadlines matter. If a document is not filed within the time the judge sets, the chance to file it is deemed waived. See 8 C.F.R. § 1003.31.

Missing court is the costliest mistake. If you receive proper notice and do not attend, the judge can order you removed in absentia. See 8 U.S.C. § 1229a.

Prepare early. Gather identity documents, your copy of the I-589, the evidence you have, and the names of any witnesses.

Can a Pending Asylum Case Lead to Deportation?

A referral does not by itself order you deported, but a denial followed by a final order can lead to removal, and if you were given written notice and do not attend a hearing, you shall be ordered removed in absentia when the government proves the notice and your removability by clear, unequivocal, and convincing evidence under 8 U.S.C. § 1229a(b)(5)(A). The judge’s decision in court controls what happens next.

If the judge grants asylum, the grant lasts for an indefinite period. It is subject to termination as the rule provides. See 8 C.F.R. § 208.14.

If the judge denies asylum, you may appeal to the Board of Immigration Appeals. In most cases, the Board must receive Form EOIR-26 (Notice of Appeal) within 10 calendar days of the Immigration Judge’s decision (8 C.F.R. § 1003.38(b)(1)). However, where the Immigration Judge adjudicated an asylum application and did not deny it under section 208(a)(2)(A), (B), or (C) of the Act, the filing deadline is 30 calendar days (8 C.F.R. § 1003.38(b)(2)). See 8 C.F.R. § 1003.38. The appeal clock starts from the oral decision or from the notice of a written decision.

A Notice of Appeal must come with the filing fee or an Appeal Fee Waiver Request (Form EOIR-26A). Without one, the appeal is not properly filed.

See 8 C.F.R. § 208.7.

Only file a claim you believe is true. The law says a knowingly frivolous asylum application makes a person permanently ineligible for any benefits under the chapter. See 8 U.S.C. § 1158.

Outcomes depend on the facts of each case.

Detention, Work Permits, and Travel Questions to Raise Early

Detention, work permits, and travel are separate questions. Each can affect your case, so raise them early.

Detention falls under 8 U.S.C. § 1226. That statute gives the government discretion over detention. It also says no court may set aside a detention decision made under that section. If a relative is held, the ICE Online Detainee Locator System is the official tool for finding people in ICE detention.

Work permits come with a waiting period. For asylum applications filed on or after April 1, 1997, no employment authorization can be issued before the 180-day period after filing ends. See 8 C.F.R. § 208.7.

Travel is risky too. Leaving the United States without advance parole, which is permission to travel that you must get first, presumes you have abandoned your asylum application. See 8 C.F.R. § 208.8.

Ask about these points before you plan a trip or a job.

Checking Your Court Date Safely and Avoiding Scams

Confirm your hearing date from the papers the government sent you. Be careful with anyone who wants payment to change it.

Your notice must state the time and place of your proceedings. See 8 U.S.C. § 1229. If the time or place changes, the law requires written notice of that change, unless the alien is not in detention and has failed to provide the address required under paragraph (1)(F). Keep every notice you receive.

Treat any caller, text, or website that promises to change, cancel, or “fix” your court date for a fee as a warning sign. Compare any message against the official notice you already have before you act.

If someone says they are from USCIS or the court, ask for the case details. Check those details against your own papers before you answer or pay anything.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Talk With Our Team About Your Referral

If a referral letter arrived without warning, you may be planning around a hearing date you did not choose.
