The government asks an immigration judge to order a person removed, and defense means answering that request with evidence, filings, and applications for relief. 8 U.S.C. § 1229a governs removal proceedings.

This work fits people who:

Received a Notice to Appear, the charging document that starts removal proceedings

Have a master or merits hearing on the calendar

Are detained or were released on bond

Face removal after a criminal arrest, conviction, or immigration violation

AG Immigration Law P.A. focuses on removal defense. The firm also handles adjustment of status, family petitions, naturalization, removal of conditions on green cards, waivers, and BIA appeals. Adriana Gomez is the responsible lawyer for this page. Our team, including the firm’s lawyers and support staff, works on removal matters together. For the full practice overview, see removal defense services.

What Representation Covers in Immigration Court

Representation covers every filing and hearing from the Notice to Appear through the final decision. That work includes:

Reviewing the Notice to Appear and the charges listed in it

Filing an entry of appearance on Form EOIR-28, which makes the lawyer the practitioner of record in immigration court (8 CFR 1003.17)

Preparing applications for relief and gathering supporting evidence

Preparing witnesses and presenting evidence at hearings

Filing bond requests when detention is at issue

Filing a motion to reopen when new facts come to light

Preparing a Notice of Appeal to the Board of Immigration Appeals (BIA)

Common relief includes cancellation of removal and asylum. Under the statute, a person who is physically present in the United States may apply for asylum, subject to its conditions (8 U.S.C. § 1158). For cancellation of removal, the continuous residence period ends when a Notice to Appear is served, with a limited exception. Which relief fits depends on the facts.

Appeals start with a Notice of Appeal (Form EOIR-26) filed directly with the BIA, within the time set in 8 CFR 1003.38. The notice must state the reasons for the appeal and name the findings or legal conclusions being challenged (8 CFR 1003.3). When no transcript is needed, briefs are due from both sides within 20 days after the Board sets the schedule, and no later than 35 days after the appeal was filed.

Criminal Grounds That Can Lead to Removal Proceedings

Certain criminal convictions can make a noncitizen deportable, and the immigration result can differ from the criminal sentence. The statute lists specific grounds. A person can be deportable after admission for a conviction of a crime of domestic violence, stalking, or child abuse, child neglect, or child abandonment.

The same section covers violations of certain protection orders. A person can be deportable if a court finds that they violated the part of the order that protects against credible threats of violence, repeated harassment, or bodily injury.

Minor offenses and traffic citations can still appear in an immigration review. Whether a charge matters turns on how the statute classifies it and what the record shows. Timing matters too. Certain offenses can end a continuous residence period, so the date of an offense can affect eligibility. Review the full criminal record before any plea or immigration filing.

How the Process Works: From First Call to Final Decision

A removal case moves through a set of stages. These run from the Notice to Appear through hearings, relief filings, the judge’s decision, and any appeal.

Contact the office. Use the contact form, call the office, or message on WhatsApp. Share the Notice to Appear and the next hearing date.

Book a paid consultation. The lawyer reviews your documents, discusses your options, and helps you decide whether to hire the firm.

File the appearance. Once you hire the firm, the lawyer files Form EOIR-28 and starts collecting records.

Prepare each hearing. Filings, evidence, and witness statements go to the court on a set schedule.

If the judge decides that you are removable and orders you removed, the judge must inform you of the right to appeal that decision.

Timing rules matter early. The first hearing cannot be set sooner than 10 days after the Notice to Appear is served, unless you ask for an earlier date in writing (8 U.S.C. § 1229). You must also give the government a written address and phone number right away.

Missing a hearing carries serious risk. If you do not attend a hearing after written notice has been provided to you or your counsel of record, 8 U.S.C. § 1229a(b)(5) provides that you shall be ordered removed in absentia if DHS establishes by clear, unequivocal, and convincing evidence that the notice was provided and that you are removable. Under the statute, that order can be rescinded through a motion to reopen filed within 180 days after the date of the order if you demonstrate that you missed the hearing because of exceptional circumstances, or through a motion to reopen filed at any time if you demonstrate that you did not receive notice as the law requires, or that you were in federal or state custody and your absence was through no fault of your own.

No one can predict how long a case will take. Court calendars and case complexity vary.

Why Work With AG Immigration Law P.A.

AG Immigration Law P.A. concentrates its work in removal defense and the related immigration matters listed above.
