The federal rules presume that an applicant who leaves without first getting advance parole has abandoned the application. Travel inside the country raises a different question, and the biggest practical risk there is a missed hearing.

People searching this topic are often asking for themselves or for someone close to them. A trip usually comes up in the middle of a case. A family emergency, a funeral, or a work assignment can make travel feel urgent. These are federal rules, so the same text applies in Miami, Houston, or New York City.

The question many people type is: can I travel with pending asylum case immigration court? The short answer is that leaving the country is the riskiest move. The details below explain why.

What a Pending Asylum Case in Immigration Court Means

A pending asylum case is one the immigration judge has not decided yet. Asylum protects people who fear persecution in their home country on protected grounds. When a charging document has been filed with the Immigration Court, an immigration judge has exclusive jurisdiction over asylum applications filed by an alien served with Form I-221, Form I-122, or Form I-862. For certain aliens not entitled to proceedings under section 240 of the Act, an immigration judge has exclusive jurisdiction over any asylum application filed on or after April 1, 1997, once Form I-863 has been filed with the Immigration Court.

Under 8 CFR 1208.2 on jurisdiction, an immigration judge has exclusive jurisdiction over asylum applications filed by an alien who has been served a Form I-221, Order to Show Cause; Form I-122, Notice to Applicant for Admission Detained for a Hearing before an Immigration Judge; or Form I-862, Notice to Appear, after the charging document has been filed with the Immigration Court.

Hearing dates and court orders can affect a removal case while it is pending, so it is wise to review any notices you receive with a lawyer. Many readers are asking on behalf of someone else. The answer depends on the facts of that person’s case, including where the case stands and which hearings are set.

If a trip or family emergency has you weighing a flight while your asylum case is still open, you don't have to sort out the risk alone; reach out to talk through your file. The rule says an applicant who leaves the United States without first obtaining advance parole is presumed to have abandoned the application (8 CFR 1208.8 on travel limits). 8 C.F.R. § 1208.8 reads: “(b) An applicant who leaves the United States pursuant to advance parole under § 1212.5(f) of this chapter and returns to the country of claimed persecution shall be presumed to have abandoned his or her application, unless the applicant is able to establish compelling reasons for such return.”

Returning is also a risk. An applicant who leaves on advance parole and returns to the country of claimed persecution is presumed to have abandoned the application. That is true unless compelling reasons for the return are shown under the same rule.

Leaving during removal proceedings has its own rule.

Timing matters as well. Whether a hearing is coming up, and whether an order already exists, changes the picture. A lawyer reviews the actual file before any trip is booked.

Advance Parole and Travel Documents for Asylum Applicants

Advance parole is the permission the rules name before you leave. The presumption of abandonment applies to an applicant who leaves without first obtaining it (8 CFR 1208.8 on travel limits). Get that step done before you depart, not after.

Even with advance parole, returning to the country of claimed persecution is a serious problem. The same rule presumes abandonment there unless compelling reasons for the return are shown.

Travel documents are a separate question. Eligibility and timing turn on where your asylum case stands and what kind of document is requested. Don’t assume that a document available at one stage will work at another.

Can I Travel Within the United States While My Asylum Case Is Pending?

The rules quoted above focus on leaving the country. Domestic travel is a different question, and the main practical risk is missing a hearing.

The rule says failure to appear for a scheduled hearing without prior authorization may result in dismissal of the application and an order of removal in absentia (8 CFR 1208.10). 8 C.F.R. § 1208.10 reads: “Failure to appear for a scheduled immigration hearing without prior authorization may result in dismissal of the application and the entry of an order of deportation or removal in absentia.” In removal proceedings, the judge must order removal in absentia if the government shows, by clear, unequivocal, and convincing evidence, that the person is removable. 8 C.F.R. § 1208.10 reads: “Failure to comply with processing requirements for biometrics and other biographical information within the time allowed will result in dismissal of the application, unless the applicant demonstrates that such failure was the result of good cause.” The government must also show, by the same clear, unequivocal, and convincing evidence, that written notice of the hearing and its consequences was provided to the person or their lawyer of record. Notice sent to the most recent address the person gave is enough, and if the person did not provide their address as required, no written notice is needed for the judge to go ahead with an in absentia hearing (8 CFR 1003.26).

Plan around the court calendar. Before any trip, confirm the date of your next hearing. Check that the court has your current address. Carry proof of your pending case, so you can show your status if asked.

Domestic trips that overlap a hearing date carry the clearest danger.

Can I Be Deported If My Asylum Case Is Pending?

Yes, an order can be entered if you miss a hearing. A pending asylum claim does not block an in absentia order if you fail to appear.

The penalty can last for years. After an in absentia removal order, a person who received oral notice of the consequences is not eligible for certain relief for 10 years. The exception is exceptional circumstances, as the statute defines them (8 U.S.C. 1229a).

A motion to reopen may be an option. The general deadline is 90 days from the final order of removal, but an in absentia order for a missed hearing may be rescinded on a motion to reopen filed within 180 days if exceptional circumstances caused the failure to appear. It may also be rescinded on a motion filed at any time if the person did not receive the required notice of the hearing, or was in federal or state custody and the failure to appear was through no fault of their own. A party may file only one motion to reopen, subject to listed exceptions (8 CFR 1003.23). Filing the motion does not automatically stay removal, except in cases involving in absentia orders, where the filing of a motion to reopen stays the removal pending decision on the motion (8 CFR 1003.23). The alien can ask the judge for a stay.

Deadlines are short, so act quickly if a hearing has been missed. Each step turns on details in the file, so the record should be reviewed without delay.

Keeping the Court and USCIS Informed of Address Changes

You must tell the immigration court about an address change within five days, using Form EOIR-33 (8 CFR 1003.15). The form goes to the court where the charging document was filed, or, if venue has been changed, to the Immigration Court to which venue has been changed.

Federal rules also require people who must register to report address changes within ten days (8 U.S.C. 1305). The reporting rule for registered people, except those exempted by section 263(b) of the Act, also follows USCIS instructions (8 CFR 265.1).

Notices go to the address on file. Written notice sent to the most recent address you gave is sufficient for an in absentia hearing (8 CFR 1003.26). If you moved and did not update the court, a notice sent to your last address can still count.

Your hearing notice also carries a warning. Update the court within five days of any change of address.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Questions to Settle Before Any Trip

Before any trip, a lawyer needs the facts of your case. Gather the date of your next hearing. Note whether the judge has entered any order. Record where your asylum application stands, the reason for the trip, and any earlier departures from the United States. Each rule above turns on timing and on how a person left, so these facts matter.

Removal defense is the core of this practice. Asylum claims often arise inside removal proceedings, which is where that work fits. The practice also handles appeals to the Board of Immigration Appeals.

Adriana Gomez is the responsible lawyer for this page.

Talk With AG Immigration Law About Your Situation

If you are weighing a trip against a pending asylum case, you are making a hard choice under pressure.
