The honest answer turns on the relief being sought, the facts that support eligibility, the evidence in the file, and the court that hears the case. This page explains what shapes the outcome and how to read the statistics you may see online.

Why there is no single winning percentage for an immigration case

No single percentage fits every immigration case, because each case turns on its own legal test. Removal defense, adjustment of status, family petitions, naturalization, removal of conditions on a green card, waivers, and BIA appeals each ask different questions.

Two people in the same immigration court can face very different issues. One may be defending against a charge that they can be removed. The other may need a waiver to overcome a bar on admission. A general number can’t describe either one.

Each form of relief also has its own paperwork, deadlines, and proof. A plan that works for one case may not fit another. The useful starting point is the specific relief that is realistically available, and the facts that support it or could block it.

Our office focuses on these immigration matters, and removal defense is the main practice area behind this page. You can start with the removal defense overview.

If a Notice to Appear or removal order has arrived for you or someone you love, you don't have to sort through the options alone, and our Miami office is ready to talk. Government data on immigration courts counts outcomes across many matters. A court’s grant rate or denial rate is an average. It doesn’t tell you how one judge will weigh one person’s evidence.

The same data can look very different depending on how it is framed. A rate can be calculated from all completed cases, from only cases that reached a final decision, or from one category of relief. Each choice changes the number. Check the base before you trust the percentage.

Some articles describe a single case or one judge’s record. A single story can’t be extended to a new case with different facts, different evidence, and a different legal claim.

Federal law also limits some outcomes by number. A statistic about asylum, cancellation of removal, or another category does not predict how your own case will be decided.

The factors that shape the outcome of a removal case

Four things carry the most weight: eligibility, evidence, credibility, and timing. Each one is set by a rule.

Eligibility comes first. A respondent must prove eligibility for the benefit requested and that it should be granted as a matter of discretion. If the evidence suggests a mandatory denial ground may apply, the respondent must prove by a preponderance of the evidence that it does not. See 8 CFR 1240.8.

For a respondent charged with deportability, the government must prove the charge by clear and convincing evidence.

Evidence and credibility matter too. Under this section, the respondent has the burden of establishing that he or she is eligible for any requested benefit or privilege. The judge may look at demeanor, candor, plausibility, and consistency. An inconsistency doesn’t have to go to the heart of the claim to count.

Timing can close doors. A missed hearing can change the options that remain. Read what to do if you missed a court date.

Careful preparation gives the judge a complete record to weigh. It does not promise any result.

How outcomes can differ by court, judge, and case type

The same facts can lead to different results in different courts and under different legal tests. Judges differ, and each one weighs testimony and documents within the rules. Detention status and hearing logistics can also affect how a case moves.

Asylum has its own burden. The applicant must establish refugee status, and a prior credible fear finding does not remove that extra burden (8 CFR 1208.13). Cancellation of removal is filed on Form EOIR-42 with the immigration court, and only after jurisdiction has vested (8 CFR 1240.20).

Adjustment of status and waivers follow other standards. Decisions of the Board of Immigration Appeals and decisions of the Attorney General are binding on all officers and employees of DHS or immigration judges in the administration of the immigration laws of the United States, except as Board decisions may be modified or overruled by the Board or the Attorney General (8 C.F.R. § 1003.1).

Florida cases also sit under a federal appeals court.

Knowing what a hearing involves helps you prepare. Read what to expect at an immigration hearing.

What happens after a decision: appeals and how long they take

An immigration judge’s decision can be appealed to the Board of Immigration Appeals, but the deadline is short. The Notice of Appeal (Form EOIR-26) must reach the Board within 10 calendar days of the decision. Certain asylum cases have 30 calendar days (8 CFR 1003.38).

The clock runs from the oral decision, or from mailing or electronic notice of a written decision. If the last day falls on a weekend or legal holiday, the deadline moves to the next business day.

The fee, or a fee waiver request (Form EOIR-26A), must be filed with the notice. If the fee or Appeal Fee Waiver Request (Form EOIR-26A) is not filed within the specified time period, the appeal is not properly filed. Any issue left out of the notice is waived (8 CFR 1003.38).

The notice must also be filed directly with the Board within 10 calendar days of the Immigration Judge’s decision (30 calendar days in certain asylum cases). It must name the findings of fact or conclusions of law being challenged, and cite supporting authority for any legal question (8 CFR 1003.3).

When no transcript is needed, briefs are due simultaneously from both parties within 20 days after the Board sets the schedule, and in no case more than 35 days after the appeal was filed. Workload or travel plans are not exceptional circumstances for an extension (8 CFR 1003.3).

Benefit applications have their own timelines, too. For a pending green card, see why it can take so long for a green card to arrive.

Common questions readers ask about their odds
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do immigration appeals take?

The total time varies by case.
