In short, the judge confirms who you are, reads the charges, and sets the next steps. Later hearings can decide whether you may stay in the United States. This guide walks through each stage in plain language and cites the rules behind each step, so you can check them yourself. Adriana Gomez is the responsible lawyer for this page.

What Is Immigration Court?

Immigration court handles removal cases, which decide whether a person must leave the United States. These cases are different from criminal cases, and they follow their own procedures. The rules for removal proceedings are set out in 8 U.S.C. § 1229a. Immigration judges run hearings under 8 CFR 1240.10, which lists the steps the judge must follow at the start of a hearing.

At a hearing, you can ask the judge for relief from removal. Relief can include waivers and adjustment of status, which are two ways to seek permission to remain. You may have a lawyer or another qualified representative with you, as 8 CFR 1240.3 allows. Our removal defense overview explains the broader picture.

If you hold a notice or court date you did not expect, our team can talk through your situation with you and explain your options. The notice lists the charges against you and the facts the government alleges.

A Notice to Appear is not the same as a hearing notice. The hearing notice gives the date, time, and courtroom for your appearance. Read both documents carefully and keep them together. If you want to understand how a notice can be issued, see our page on how a notice to appear is issued.

Do not ignore a court notice. If you do not attend, the judge may order removal in absentia.

Types of Immigration Hearings: Master Calendar and Individual Hearings

Most cases start with master calendar hearings, and some go on to an individual hearing. A master calendar hearing is usually short. The judge confirms your identity, reads the charges, and asks you to admit or deny the factual allegations and the charge.

An individual hearing, sometimes called a merits hearing, is where the evidence comes in. You may examine and object to the evidence against you, present evidence in your own behalf, and cross-examine government witnesses, as 8 CFR 1240.10(a) explains, but you are not entitled to examine national security information the government offers in opposition to your admission or to an application for discretionary relief. A case can include several master calendar hearings before an individual hearing is set.

How to Prepare for Immigration Court

Preparation starts with your notice. Confirm the date, time, courtroom, and case number. Keep copies of every court paper you receive, and bring the originals to the hearing.

Your address matters. Within five days of any change, you must file written notice on Form EOIR-33 with the immigration court, under 8 CFR 1003.15(d). Separately, 8 U.S.C. § 1305(a) says each alien required to be registered who is within the United States must notify the Attorney General in writing of each change of address within ten days from the date of such change.

Gather your identity papers, immigration papers, and records that show your relationships or time in the United States. If the judge asks for proof that supports your testimony, you must provide it. Corroborating evidence must be provided, when the judge determines that you, as an applicant for relief, should provide evidence that corroborates otherwise credible testimony, unless you show that you do not have it and cannot reasonably obtain it. A lawyer can review your papers and explain which records matter in your case.

What Happens on the Day of Your Hearing

Arrive early. Expect security screening at the courthouse. Check in as directed and wait for your case to be called.

In the courtroom, you will see the judge, government counsel, yourself, and any lawyer or representative. The judge places you under oath and reads the charges in the notice, explaining them in non-technical language, under 8 CFR 1240.10(a). The judge also explains your right to a reasonable opportunity to examine and object to evidence against you, but you are not entitled to examine national security information the government offers in opposition to your admission or to an application for discretionary relief.

Dress and speak with respect. Answer questions directly and clearly. If your lawyer needs more time to review documents, you can ask. After the commencement of the hearing, the judge may grant a reasonable adjournment either at the judge’s own instance or, for good cause shown, upon application by you or the Department of Homeland Security, under 8 CFR 1240.6, but no adjournment may cause adjudication of an asylum application to exceed 180 days in the absence of exceptional circumstances. The judge decides whether to grant the request.

Can I Use an Interpreter at Immigration Court?

An interpreter translates the hearing so you can follow every word. Tell the court and your lawyer about your language needs before the hearing, and ask about interpreter arrangements for your date. Any interpreter in a hearing must be sworn to interpret and translate accurately, under 8 CFR 1240.5, unless the interpreter is a U.S. Government employee. 8 C.F.R. § 1240.5 reads: “Any person acting as an interpreter in a hearing before an immigration judge under this part shall be sworn to interpret and translate accurately, unless the interpreter is an employee of the United States Government, in which event no such oath shall be required.”

The process is simple. The judge speaks, the interpreter repeats the words in your language, and you answer through the interpreter. Wait for the interpreter to finish before you respond. If a question is unclear, ask for it to be repeated. Taking a moment to think is fine.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

What Happens During an Individual Hearing?

At an individual hearing, the judge hears evidence and testimony, then decides the case. You may testify, present documents, and call witnesses. Government counsel may cross-examine you and your witnesses.

The judge weighs your testimony and considers the whole picture. The judge may look at demeanor, candor, and responsiveness. The judge may also consider whether your account is plausible and whether your statements are consistent with each other and with the other evidence.

The decision can be oral or written. It must include a finding on inadmissibility or deportability, the reasons for the decision, and an order, under 8 CFR 1240.12(a). The reasons for the appeal must be stated in that notice, under 8 CFR 1240.15. Custody and bond decisions made by the Department of Homeland Security pursuant to 8 CFR part 1236 can be reviewed by an immigration judge, under 8 CFR 1003.19(a).

A later request for a bond review must be made in writing.
