Venue means the court where your case is heard. Under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-20\/title-8\/section-1003.20\">8 C.F.R. \u00a7 1003.20<\/a>, venue lies at the court where jurisdiction vests, and a judge may change it only on a motion from one of the parties, after the charging document has been filed with the immigration court.<\/p>\n<p>The written request is called a motion to change venue. The judge may grant it only for good cause. The other side must get notice and a chance to respond first.<\/p>\n<p>A filed motion is not a granted one, so keep attending every scheduled hearing.<\/p>\n<p>Can you move a case to another state? The judge cannot grant a change without it under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-20\/title-8\/section-1003.20\">8 C.F.R. \u00a7 1003.20<\/a>.<\/li>\n<li><strong>Optional supporting papers<\/strong> showing where you now live. Some people attach these as a practical step, though the rule itself only requires that you identify a fixed street address, including city, state and ZIP code, where you can be reached for hearing notices.<\/li>\n<li><strong>Reasons for the request<\/strong>, such as distance, work, or caregiving, backed by documents.<\/li>\n<li><strong>Certificate of service<\/strong> on paper filings. Separately, <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/8\/1305\">8 U.S.C. \u00a7 1305<\/a> requires each alien required to be registered under this subchapter who is within the United States to notify the Attorney General in writing of a change of address within ten days.<\/li>\n<li><strong>Missing a hearing.<\/strong> A judge shall order removal in absentia if the government establishes removability by clear, unequivocal, and convincing evidence and that written notice of the time, place, and consequences of failure to appear was provided. Notice sent to your most recent address on file can be enough, under <a href=\"https:\/\/www.ecfr.gov\/on\/2026-10-20\/title-8\/section-1003.26\">8 C.F.R. \u00a7 1003.26<\/a>.<\/li>\n<li><strong>Filing without proof.<\/strong> A motion without residence documents or reasons is weaker.<\/li>\n<li><strong>Using a template.<\/strong> Forms and sample motions do not check your deadlines or case facts.<\/li>\n<li><strong>Waiting too long.<\/strong> Acting late can leave less time before your next hearing.
