Asylum can be raised as a defense to removal, and the rules are strict. This page explains how a non-detained asylum case works, step by step. You’ll learn the key deadlines, what representation covers, and what happens at each stage.

What a Non-Detained Asylum Case in Immigration Court Involves

A non-detained asylum case is an asylum claim raised inside removal proceedings while you are not held in immigration custody.

Removal proceedings start when the government asks an immigration judge to order you removed. The case begins with a Notice to Appear, a written notice that lists the charges and the court. The notice must also tell you that you may be represented by counsel (8 U.S.C. § 1229).

Defensive asylum means you ask the immigration judge to grant asylum as your defense to removal. Section 208(a)(1) of the Immigration and Nationality Act (8 U.S.C. § 1158(a)(1)) allows a noncitizen who is physically present in the United States, or who arrives in the United States, to apply for asylum regardless of immigration status, subject to the bars and exceptions listed in 8 U.S.C. § 1158(a)(2).

This page is for two groups. The first is people who received a Notice to Appear or a hearing notice and are not in custody. 8 U.S.C. § 1229 reads: “In order that an alien be permitted the opportunity to secure counsel before the first hearing date in proceedings under section 1229a of this title, the hearing date shall not be scheduled earlier than 10 days after the service of the notice to appear, unless the alien requests in writing an earlier hearing date.” The second is family members trying to understand that case.

Our practice focuses on removal defense. Asylum is one part of that work. We also handle adjustment of status, family petitions, naturalization, removal of conditions on green cards, waivers, and BIA appeals.

If a Notice to Appear or a hearing date has caught you off guard, our team can talk through your asylum options with you, and you don't have to sort it out alone. An incomplete application is rejected. You then have 30 days of rejection to correct and refile it; if you do not, absent exceptional circumstances, you are found to have abandoned the application and waived the opportunity to file such an application (asylum filing rules).

Pleadings. At an early hearing, the judge asks whether you admit or deny the allegations and removability (pleading rules).

Address updates. You must tell the court in writing about an address change within five days, on Form EOIR-33 (address change rules).

Proof and testimony. You carry the burden of proof. Identify the court and every date on the calendar.

Paid consultation. Consultations are paid. Missing a hearing carries real consequences.

Why Work With This Firm on an Asylum Case

AG Immigration Law P.A. focuses on removal defense, and Adriana Gomez is the responsible lawyer for this page.

Our team includes support staff who help track filings, deadlines, and hearing notices. Small dates matter in these cases, and the rules above show why.

Our practice covers the full removal path. That includes asylum, adjustment of status, family petitions, naturalization, removal of conditions, waivers, and BIA appeals.

Every case turns on its own facts, so no outcome can be promised.

Is an Immigration Lawyer Worth Using for an Asylum Case?

A lawyer helps you meet strict deadlines and present your claim the way the court requires.

The filing rules leave little room for error. Appeal deadlines are short, too.

A judge can also deny an asylum application without a full hearing. That can happen when no prima facie claim is shown. On a DHS motion, the judge need not hold a hearing before denying, but when the judge acts upon his or her own authority, the judge must give the parties at least 10 days’ notice first (prima facie rules).

Your testimony matters. Preparing that testimony takes careful work.

Consultations are paid, and fees depend on the facts of your matter. Ask about fee details before you decide on representation.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do I need to be detained to get help?

No. This page covers non-detained asylum cases in immigration court.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is the deadline to file for asylum?

The one-year period generally runs from your last arrival in the United States or April 1, 1997, whichever is later.
