Some exceptions exist, but you must prove them. This guide explains how the rule works once your case is in court.

Federal law sets the rule. 8 U.S.C. § 1158 says an applicant must show, by clear and convincing evidence, that the application was filed within one year after arrival. That is a high standard, and the dates matter a great deal.

What the One Year Asylum Filing Deadline Means

An asylum application must be filed within one year of your last arrival in the United States, unless an exception applies.

The statute sets the general rule in 8 U.S.C. § 1158. The regulation explains how the year is counted. 8 CFR 1208.4 says the period runs from your last arrival in the United States or April 1, 1997, whichever is later.

That means people who were already in the country on April 1, 1997 may count from that date. Everyone else counts from their most recent entry. Every entry, exit, and return matters, so write them all down.

“Last arrival” is the key phrase. The clock starts at arrival. It does not start when you get a letter, a notice, or a court date. If you arrived many years ago, the deadline may already have passed. Exceptions can still apply, and they are covered below.

If a Notice to Appear has you worried about your arrival dates, you don't have to work through the timing alone. The notice lists the charges and the time and place of the hearing.

Timing rules also apply to the first hearing. Under 8 U.S.C. § 1229, the hearing date cannot be set earlier than 10 days after the notice is served. The exception is a request for an earlier date made in writing.

These hearing dates help you plan. Court deadlines come from the judge’s orders. 8 CFR 1003.31 lets the immigration judge set and extend time limits for filing applications.

A practical step helps here. Build a dated timeline before the first hearing. List every entry, departure, and return. Add the dates on the notice and on every hearing notice. One wrong arrival date can change the whole analysis.

The Statutory Exceptions: Changed and Extraordinary Circumstances

A late asylum application can still be considered if you show changed circumstances which materially affect your eligibility for asylum, or extraordinary circumstances relating to the delay in filing.

Under 8 U.S.C. § 1158, an asylum application may be considered notwithstanding the time limit for filing if the applicant demonstrates to the satisfaction of the Attorney General either changed circumstances which materially affect the applicant’s eligibility for asylum or extraordinary circumstances relating to the delay in filing. The first is changed circumstances that materially affect your eligibility for asylum. The second is extraordinary circumstances relating to the delay in filing.

Changed circumstances are new facts that change whether you can get asylum. Extraordinary circumstances explain why the filing came late. Each one needs proof. You must show the exception, not just describe it.

8 CFR 1208.4 says the asylum officer, the immigration judge, or the Board decides whether you qualify. When an application appears to be late, that decision-maker checks the exception.

Whether an exception fits depends on the facts of each case. A common mistake is waiting too long to gather proof. Another is assuming a hard situation counts on its own. The law asks for evidence.

Filing an Asylum Application Once Proceedings Have Started

Under 8 CFR 1208.2, USCIS has initial jurisdiction over asylum applications unless an exception applies. Immigration judges have exclusive jurisdiction over asylum applications filed by a person served a Form I-221, Form I-122, or Form I-862 after the charging document has been filed with the Immigration Court. For certain categories, such as crewmembers and people admitted under the Visa Waiver Program who have remained longer than authorized or otherwise violated their status, immigration judges have exclusive jurisdiction over asylum applications filed on or after April 1, 1997, after Form I-863, Notice of Referral to Immigration Judge, has been filed with the Immigration Court; however, a person admitted under the Visa Waiver Program to the Commonwealth of the Northern Mariana Islands is not eligible for asylum in the Commonwealth of the Northern Mariana Islands before January 1, 2030.

8 CFR 1208.2 gives immigration judges exclusive jurisdiction over asylum applications filed by a person served a Notice to Appear. For certain aliens, that applies once Form I-863, Notice of Referral to Immigration Judge, has been filed with the Immigration Court.

For cases before the immigration court, the application counts as filed on the date the court receives it. 8 CFR 1208.4 states that rule. Keep proof of when and how you sent every filing.

The application is Form I-589. 8 CFR 1208.3 says it must come with proof of payment of the required fee. For filings with an immigration court, an incomplete application is rejected by the immigration court. You then have 30 days from rejection to fix it and refile. Failing to correct it or to refile on time, absent exceptional circumstances as defined in 8 CFR 1003.10(b), results in a finding that you have abandoned the application and waived the opportunity to file such an application under 8 CFR 1208.3.

Attorneys and accredited representatives must file electronically in cases eligible for electronic filing. 8 CFR 1003.31 also says a filing missed by the judge’s set deadline is deemed waived. Missing a biometrics appointment does not stop an application from counting as filed for the one-year rule, according to 8 CFR 1208.4.

The Annual Asylum Fee and Why It Matters for Timing

A pending asylum application carries an annual fee for each calendar year it stays pending.

8 U.S.C. § 1808 sets this fee. For fiscal year 2025, the amount specified in this section shall be the greater of the amounts listed in 8 U.S.C. § 1808(b)(1). Starting in fiscal year 2026, the amount adjusts for inflation each year.

The same statute says the fee shall not be waived or reduced. The application filing fee also cannot be waived, under 8 CFR 1208.3.

Treat the annual fee like a deadline. Put fee dates on your calendar next to your hearing and filing dates. Confirm the current amount when your case is reviewed, because the figure changes over time.

Keeping Your Address Current So You Do Not Miss a Notice

You must report an address change to the immigration court in writing within five days.

8 CFR 1003.15 requires written notice of a change of address on Form EOIR-33 within five days of the change. The notice goes to the immigration court that has the charging document or, if venue has been changed, to the Immigration Court to which venue has been changed. 8 U.S.C. § 1229 also requires you to give a written record of any address change immediately.

Missing a hearing can have serious results. 8 U.S.C. § 1229a allows an order entered in absentia to be rescinded only in limited cases. One path is a motion to reopen filed within 180 days, and only if the missed hearing was due to exceptional circumstances.

Keep a dated record of every notice you receive and every address form you file. Check your mail often, because hearing notices go to the address you have on record.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Other Forms of Relief Still Matter After the One-Year Bar

Under 8 CFR 1208.16, an immigration judge may adjudicate both an asylum claim and a request for withholding of removal whether or not asylum is granted.

8 CFR 1208.4 says the filing prohibition applies only to asylum under section 208 of the Act.
