This guide explains what happens next and what to do before your next hearing.

What a Withdrawal Means in Immigration Court

A withdrawal means your lawyer asks the immigration judge to let them stop representing you. Until the judge allows it, the lawyer stays the practitioner of record. Under 8 CFR 1003.17, a practitioner who enters an appearance by filing Form EOIR-28 remains the practitioner of record unless an immigration judge permits withdrawal or substitution during proceedings.

Any asylum application already filed remains in the court record. The hearing calendar keeps moving, too.

A lawyer who simply goes silent is different. That lawyer has not asked the court for anything. In both situations, you must watch the court schedule yourself. Don’t wait for a reply before you check your dates.

If your lawyer stopped responding before an asylum hearing, you don't have to work through the court schedule alone; our team can talk with you about where your case stands. Common ones include a conflict of interest, a breakdown in communication, or a client who does not provide needed information. A withdrawal request does not, by itself, show that the lawyer acted improperly. The reasons depend on the facts of each case.

Ask for the reason in writing. A short letter or email creates a record you can keep. It also helps your next lawyer understand what happened.

Some problems can be fixed quickly once you know about them, such as a missing document or an unanswered question. Others, like a conflict of interest, are for the lawyer to resolve. Knowing which kind you face helps you plan your next move.

What the Court and Your Lawyer Must Do

The usual sequence has three steps. If you did not receive copies of the motion or the decision, ask for them.

Notices and filings go to the attorney or representative of record. Under 8 CFR 1292.5, if you have no representative, they go to you. Once your lawyer leaves, court papers may come to you directly. Keep your address current.

A new lawyer must enter an appearance on Form EOIR-28. Under 8 CFR 1003.17, the practitioner of record uses that form to appear and file for you. Until the form is filed, the new lawyer is not yet the practitioner of record. Timing matters, because a hearing can come before the new form is on file. In proceedings before an Immigration Judge, you may be represented by an attorney or other representative of your choice in accordance with 8 CFR part 1292, at no expense to the government, as 8 CFR 1003.16 explains.

How the Asylum Application and Deadlines Are Affected

Missing a hearing can end your case quickly. Under 8 CFR 1208.10, failure to appear without prior authorization may lead to dismissal of the application and an order of removal entered in absentia, meaning without you present. Separately, 8 C.F.R. § 1208.10 covers biometrics: if an applicant misses the deadline for submitting biometrics and other biographical information, the application will be dismissed unless the applicant shows that the failure resulted from good cause.

Notice matters here too.

The consequences can last for years.

The asylum filing clock works differently. Under 8 CFR 1208.4, the one-year period runs from your last arrival in the United States or from April 1, 1997, whichever is later. The rule has exceptions.

A new lawyer may ask for more time. Under 8 CFR 1003.29, a judge may grant a continuance for good cause, but not one that causes the asylum application’s adjudication to exceed 180 days without exceptional circumstances. A continuance is not automatic, so don’t plan around one.

Steps to Take Before Your Next Hearing

Start with three things: your dates, your address, and your file. Write down every hearing date, the court location, and the judge’s name. Keep every notice together in one folder.

Check your address now. Under 8 CFR 1003.15, you must give written notice of an address change on Form EOIR-33 within five days. File it with the immigration court where your charging document was filed, or, if venue has been changed, with the immigration court to which venue has been changed.

Request your file in writing. Ask your current lawyer for the asylum application, supporting documents, and every filing. Keep the request and any reply.

If you hire a new lawyer, ask that lawyer to file Form EOIR-28 right away. Ask for written confirmation of the filing date, and store it in the same folder.

Bring every withdrawal letter to your next hearing. Your notes and the court record should match.

When You No Longer Trust Your Lawyer and Want to Talk It Through

Warning signs usually show up on paper. Watch for missed deadlines, long silences, filings you never saw, and refusals to share your file. Write each one down with its date.

Ask for a written accounting. You can ask your lawyer to list the work done and the fees paid. Put your questions about next steps in writing too. A written answer gives you something to check against the court record.

If you are unsure what to do before a hearing, speak with a lawyer about your own case. The right next step depends on the facts in your file and on your court date.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Talk With Our Team About Your Case Before the Next Hearing

If your lawyer has asked to withdraw and an asylum hearing is coming up, you may feel rushed.
