The bigger risk is holding back facts or changing them. Your lawyer can plan around hard facts. A changed or partial story is much harder to fix.

When people ask what not to tell the attorney, they usually mean what to keep out of conversations with other people. Friends, relatives, coworkers, and online contacts are not your lawyer. Keep the details of your case with your lawyer.

Many people reading this are not the person in the case. You may be a daughter, spouse, or friend of someone who received a notice to appear. That document starts removal proceedings. It is stressful to read it for someone you care about, and it’s normal to want clear answers first.

This page gives general principles for removal defense. For an overview of how this office handles these matters, see our removal defense page.

If someone you love just received a notice to appear, you don't have to sort through the facts alone. Your lawyer needs to know how and when you entered the United States. They also need to know about earlier contact with immigration or police, prior applications, and your family ties. The respondent may be represented at the hearing by an attorney or other representative qualified under 8 CFR part 1292 (8 CFR § 1240.3).

Some facts feel damaging, so people hide them. Examples include a prior arrest, an earlier removal order, a past false claim to U.S. citizenship, or staying past the date on a visa. These facts still matter to strategy. Your lawyer cannot plan around facts they never hear. A fact that surfaces later, in court or in a filing, can hurt more than it would have at the start.

Entry is a common focus. In a removal proceeding, the person must show the time, place, and manner of entry. If that burden is not met, the person is presumed to be in the United States in violation of law (8 U.S.C. § 1361). Under 8 U.S.C. § 1361, a person who applies for a visa or other entry document, applies for admission, or otherwise attempts to enter the United States has the burden of proof to establish that they are eligible for that document or are not inadmissible under any provision of the chapter and, if they are an alien, that they are entitled to the status claimed.

Bring dates, travel history, and documents, even if you are unsure of the details. Write down what you remember and mark what you are not sure about.

Is everything you say to a lawyer confidential?

Generally, yes. This protection is called attorney-client privilege.

Whether a specific conversation is protected depends on the facts.

Ask your lawyer about privacy questions before you share sensitive details.

What to keep out of conversations with others

Keep case details out of talks with friends, family, coworkers, and online contacts.

Social media can cause problems too. Posts, messages, photos, and comments can be used as evidence. They can also contradict what you tell your lawyer. Pause before you post about your case, your travel, or your status.

Officers are another risk. The immigration judge may receive in evidence any oral or written statement that is material and relevant to any issue in the case, previously made by you or any other person during any investigation, examination, hearing, or trial (8 CFR § 1240.7). Talk with your lawyer before you discuss your case with any immigration or law enforcement officer.

Think about who is in the room, too. If someone outside the legal matter joins a meeting with your lawyer, that can affect how privacy applies. Ask your lawyer who should attend.

Mistakes that can hurt a removal case

Do not guess. Saying “I do not remember” or “I am not sure” is better than giving an answer you cannot back up.

Watch out for these common mistakes:

Exaggerating or minimizing events

Leaving out events because of embarrassment or fear

Giving one version on forms and another in court

Altering, hiding, or withholding documents

Credibility matters. A small mismatch in dates can still cause trouble.

Documents carry weight, too. Bring originals or copies of everything relevant, and tell your lawyer what you cannot find.

How to prepare for your first meeting

Start with a written timeline. Include each entry, departure, and move you can recall. Gather passports, travel records, immigration notices, court papers, and records of any prior arrests or applications.

Make a list of questions before the meeting. Mark the facts you are unsure about. That helps your lawyer decide what needs checking.

Timing matters too. The first hearing date cannot be set earlier than 10 days after the notice to appear is served. The exception is when the person asks in writing for an earlier date. The rule gives time to secure counsel (8 U.S.C. § 1229).

You may be worried about a relative or friend in this situation. The choice to get help belongs to them, and it helps to decide together.

Quick answers

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is what I tell my immigration lawyer confidential?

Generally yes, when the talk is private and made to get legal advice.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Should I tell my lawyer everything, even if I did something wrong?

Yes.
