In immigration court, the same request is called a change of venue. Which rules apply depends on the facts of each case.

This guide explains what the request asks for, the rule that governs it, and what judges look at. It also answers a common question: can a judge say no? This page is the responsibility of Adriana Gomez. It is general information, not advice about your own case.

What a motion to transfer venue asks a court to do

A motion to transfer venue asks a judge to move a case to a different location. Venue means the proper place for a case to be heard. It is not the same as jurisdiction. Jurisdiction asks whether a court has power to decide the case at all. Venue asks where the case should sit.

One party files the motion, and the judge can change venue only after the charging document has been filed with the Immigration Court. The other side then gets a chance to respond. The judge decides whether the request should be granted. Each step matters, because the judge cannot act on the request alone.

People often see this term in two places. Federal civil lawsuits have their own transfer rules. Immigration court has its own change of venue rule. The two systems are separate, and the words can sound alike. In a removal case, the immigration rule is the one that applies.

If a family member's case has reached this point, we can talk through what it means for them, and you don't have to figure it out alone. The rule starts with a simple point. Venue lies at the Immigration Court where jurisdiction vests under § 1003.14.

The rule then explains how a change can happen. The rule says the Immigration Judge, “for good cause, may change venue only upon motion by one of the parties, after the charging document has been filed with the Immigration Court.” The charging document is the paper that starts the case. A judge cannot change venue on the judge’s own initiative.

Current federal regulations, including Chapter V on immigration proceedings, appear in the eCFR Title 8 collection. Always check the current text before you rely on any rule.

What a judge looks for before changing venue

A judge may change venue only for good cause. The judge must also give the other side notice and an opportunity to respond. Both steps protect each party. The judge does not act on a motion the other side never had a chance to answer.

The rule also requires a fixed address. No change of venue can be granted without a fixed street address, including city, state and ZIP code. The respondent or applicant must be reachable there for hearing notices. The respondent is the person in removal proceedings.

Good cause is the central question. The rule does not list every reason that counts. The judge looks at the reasons given in the motion and the facts behind them. A motion with unclear reasons, or with an outdated address, gives the judge less to work with.

Filing a motion to change venue in Texas, Florida and New York

That includes courts in Texas, Florida and New York. A respondent in Houston, San Antonio, Orlando, Miami or New York City faces the same regulation.

The motion explains the reasons for the request. It also shows that the other side received a copy. A change of venue cannot be granted without identification of a fixed street address, including city, state and ZIP code, where the respondent can be reached for hearing notification. Missing any of these pieces can slow the request down.

Many cases involve a person held in immigration detention. If the person is held in ICE custody, the ICE Online Detainee Locator System is the official tool for finding where someone is held. Knowing the detention location helps families plan the address and the next steps.

How long a change of venue takes and whether a judge can deny it

Yes, a judge can deny a motion to change venue. The rule says the judge “may” change venue for good cause. That word gives the judge discretion. If the judge does not find good cause, the judge can say no.

Timing varies. It depends on the court’s schedule and on whether the other side responds. The rule requires notice and a chance to respond, so the other side’s reply is part of the process. Do not expect a fixed timeline from a general guide.

After a ruling, the next steps depend on what the judge decided and on the facts of the case. Decisions of the Board of Immigration Appeals (BIA) are published by the Executive Office for Immigration Review. The EOIR precedent decisions page lists them.

How this differs from federal civil transfer and where review goes

An immigration court change of venue is different from a transfer between federal civil courts. 8 C.F.R. § 1003.20 says venue lies at the Immigration Court where jurisdiction vests under § 1003.14, and an Immigration Judge decides whether to change venue on motion for good cause. Federal civil cases follow their own transfer rules and decision-makers. If your question involves a removal case, the immigration rule is the one that counts.

Which court hears an appeal from a BIA decision depends on the circumstances of each case. The Eleventh Circuit published opinions page shows the binding precedent that court has issued on those petitions.
