It applies to people who have received formal notice of a case.

Removal defense is for people who:

Received a Notice to Appear, the document that starts a removal case

Have a hearing date on the immigration court calendar

Have a removal order and want to seek review

The immigration judge decides removability based only on the evidence produced at the hearing. The judge decides removability based only on the evidence produced at the hearing, so what you file and what you say under oath matter a great deal.

For a respondent charged as deportable, the government must prove removability by clear and convincing evidence; different burdens apply to arriving aliens and to respondents present without admission or parole under 8 C.F.R. § 1240.8(b) and (c). 8 C.F.R. § 1240.8 You still carry the burden to show you qualify for any relief you request. When you ask an immigration judge for relief from removal, it is up to you to show both that you qualify for the benefit you are requesting and that the judge should grant it as a matter of discretion (8 C.F.R. § 1240.8(d)).

Asylum and Other Relief Raised in Immigration Court

Asylum, withholding of removal, and protection under the Convention Against Torture can all be raised as defenses inside immigration court. Each asks the judge to let you stay for a different reason.

The judge may decide an asylum claim and a request for withholding of removal together. The judge can do this whether or not asylum is granted. 8 C.F.R. § 1208.16 For a Convention Against Torture claim, the judge first asks whether you are more likely than not to be tortured in the country of removal. 8 C.F.R. § 1208.16

Timing matters.
