A referral under 8 CFR 208.14 sends your asylum claim, when you appear to be inadmissible or deportable under section 212(a) or 237(a) of the Act, to an immigration judge, who decides it in removal proceedings. This page explains what the word “refer” means, what usually follows, and what to prepare. AG Immigration Law P.A. focuses on removal defense, and this page covers that area.

What an asylum referral means under 8 CFR 208.14

A referral is an asylum officer’s decision to send your application to immigration court. Under 8 CFR 208.14(c)(1), the officer refers the application when it does not grant asylum after an interview. The officer sends the application to an immigration judge with the charging document.

A referral is not a final ruling on your claim. The officer is sending the claim forward so a judge can decide it. Your paperwork may say “refer” or “referred” instead of “denied.” Look for the phrase “Notice to Appear,” because that document starts court proceedings.

The rule also allows dismissal. If charging documents may not be issued, the officer dismisses the application instead of referring it. A dismissal and a referral lead to different places. Confirm which outcome your notice describes.

Getting a letter that says "refer" can leave you unsure whether the case is over, and it's harder when you heard about it secondhand; our team can talk through your notices with you. After a referral, an immigration judge hears the case in immigration court. Under 8 CFR 1208.13, for applications filed on or after April 1, 1997, an applicant does not qualify for asylum if section 208(a)(2) or 208(b)(2) of the Act applies. An applicant found ineligible on that basis is still considered for withholding of removal. The procedures in 8 C.F.R. § 1003.47 cover any application for immigration relief, protection, or restriction on removal that is subject to the conduct of identity, law enforcement, or security investigations or examinations, so that DHS has completed the appropriate investigations or examinations before the application is adjudicated.

So, does asylum referral mean my case was denied? Not on its own. A referral moves the claim into court, where a judge reviews it again.

Keep every USCIS notice and all interview papers together, in date order. Dates and wording on those papers matter later. If a family member received the letter, ask them for the original and any envelopes. Write down what the officer asked you and how you answered, while you still remember it.

What happens after the referral

The next step is a Notice to Appear. Under 8 U.S.C. § 1229, this written notice must state the nature of the proceedings. It must also list the acts alleged to violate law, the charges, and the statutory provisions involved. It is served in person or, if personal service is not practicable, by mail to you or your counsel of record.

You must give the court a written address and phone number right away. You must report any change to them immediately. The same statute says the first hearing cannot be set earlier than 10 days after service. You can ask in writing for an earlier date. The 10 days give you time to secure counsel.

The Immigration Court scheduling rules say the court schedules cases. The court also gives notice of the time, place, and date of each hearing. Under 8 CFR 1240.10(c), you state whether you admit or deny the factual allegations and your removability.

Hearings can be in person or by video. The 8 U.S.C. § 1229a rules allow a merits hearing by telephone only with your consent. Before an evidentiary hearing on the merits can be held by telephone, you must consent after being told you may proceed in person or through video conference.

How an immigration judge reviews the asylum claim

The judge reviews your claim on the record, including your testimony and evidence. The burden of proof is on you. Under 8 CFR 1208.13(a), the applicant must establish that they are a refugee. Testimony, if credible, may be enough without other proof.

Under 8 U.S.C. § 1158, testimony alone sustains the burden only if the judge finds it credible and persuasive. It must also refer to specific facts. The judge weighs that testimony with other evidence in the record.

Under 8 CFR 1240.8(d), you also must show you are eligible for the benefit you request. You must show it should be granted as a matter of discretion. The judge looks at the whole picture, not only one part of your story.

A judge may also deny an application without a full hearing. Under 8 CFR 1208.13(e), this can happen if the application does not show a prima facie claim. Under 8 C.F.R. § 1208.13(e), an immigration judge may, if warranted by the record, pretermit and deny an asylum, withholding of removal, or Convention Against Torture application when the applicant has not established a prima facie claim for relief or protection under applicable law. This can occur on a government motion or on the judge’s own authority. When the judge acts on his or her own authority, the judge must give the parties at least 10 days’ notice before entering such an order.

How long the process can take

Timing after a referral depends on the court’s schedule and the facts of each case. Stay on top of every date in your notices. Missing a hearing after written notice can lead to a removal order entered in absentia. Under 8 U.S.C. § 1229a, the government must show by clear, unequivocal, and convincing evidence that notice was given and that the person is removable.

Under 8 U.S.C. § 1229a(c)(7), a motion to reopen generally must be filed within 90 days of the date of entry of a final administrative order of removal, and there is no time limit for an asylum-based motion based on changed country conditions if the evidence is material and was not available and would not have been discovered or presented at the previous proceeding.

Ask about the current stage of your case. Know which hearing comes next and what it requires. A date you miss can change what happens next.

Common reasons asylum claims are not granted

These are issues an immigration judge examines in asylum cases. They are not predictions about your case.

Missing corroboration. A judge may decide that evidence should back up testimony. Under 8 U.S.C. § 1158, that evidence must be provided unless the applicant does not have it and cannot reasonably obtain it.

The applicant must establish that they are a refugee under section 101(a)(42)(A) of the Act, meaning race, religion, nationality, membership in a particular social group, or political opinion was or will be at least one central reason for persecuting the applicant. Vague or general statements do not show that.

Credibility. The statute lets a judge weigh demeanor, candor, and plausibility. It also lets the judge weigh whether written and oral statements match. Inaccuracies count, even when they do not go to the heart of the claim.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

What to prepare before court

Gather these items before your next hearing:

All USCIS notices and interview papers.

The Notice to Appear and every later hearing notice.

Your asylum application and copies of everything filed.

Supporting documents that back up your account.

A dated timeline of events, written in your own words.

Language matters too.
