A Notice to Appear (NTA) is the document that starts removal proceedings in immigration court. In an asylum case, it often arrives when the claim moves to an immigration judge. It is a notice of charges, not a final decision. Knowing what it says and what to do next can protect your case.

What a Notice to Appear Is

A Notice to Appear is the government’s formal charging document. A removal case starts when the notice is filed with the immigration court, under 8 C.F.R. § 1239.1. It is also called Form I-862. Think of it as a summons to court. It is not a judge’s ruling.

An asylum application is different. It is your request for protection. The Notice to Appear is the government’s step to bring the case before a judge. Both can exist in the same case, so don’t mix them up. Your asylum claim is still yours to present in court.

If a Notice to Appear has arrived in your family's mail, you don't have to work out the court steps alone. Federal law, 8 U.S.C. § 1229, requires the notice to state the nature of the proceedings, the legal authority for them, the conduct alleged to violate the law, and the charges and statutory provisions alleged to have been violated. It also requires the time and place of the hearing.

The notice must also say you may have a lawyer represent you. See 8 C.F.R. § 1003.15. The statute gives you at least 10 days after service before the first hearing. That time lets you look for counsel, unless you ask in writing for an earlier date.

If a date changes, expect a separate written notice. Track every one. Write each date on a calendar the day you receive it. Keep copies of every envelope and page.

How an Asylum Claim Connects to Removal Proceedings

An asylum claim can lead to court when the applicant appears removable. The asylum officer then refers the application to an immigration judge with the charging document. 8 C.F.R. § 1208.14 provides for this referral.

In court, the judge hears the asylum claim inside the removal case. Your testimony must be credible, persuasive, and specific. If the judge asks for corroborating evidence, you must provide it unless you cannot reasonably get it.

A common mistake is to wait while assuming the asylum filing already handles the court case. Treat the NTA as an open court case from the first day.

What to Do After Receiving a Notice to Appear

Read the NTA, note the charges and the court address, and confirm your contact information. If the notice lacks your address or lists it incorrectly, you must give the immigration court where it was filed a written notice of your address and telephone number within five days of service. Use Form EOIR-33 under 8 C.F.R. § 1003.15.

Use this checklist:

Read the charges and the statutes listed.

Write down the court address and every date or time shown.

Confirm your address and telephone number with the court.

File a new Form EOIR-33 within five days of any change of address.

Keep every envelope, notice, and translation.

Notices go to the most recent address you gave. Keep it current.

Why Missing a Hearing Can Be Serious

If you miss a hearing without authorization, the judge may order you removed in absentia, meaning without you present. The government must show by clear, unequivocal, and convincing evidence that you are removable. The government must also show that notice was provided in writing, but 8 C.F.R. § 1003.26(d) sets out exceptions: notice sent to the most recent address the respondent provided is sufficient, and no written notice is required if the respondent failed to provide an address as required under § 1003.15(d).
