Once an asylum case is in immigration court, the judge has authority over it. What happens next depends on how the case got there and on the exact words of the judge’s order. This guide explains the main outcomes, what to check, and the dates you can’t miss.

An Immigration Judge Can End Some Asylum Cases

An immigration judge can end some asylum cases that are before the court, and the written order controls what that means. The court’s power starts once the case is filed there. 8 C.F.R. § 1003.14 says proceedings before an immigration judge begin when a charging document is filed with the court. 8 C.F.R. § 1208.2 adds that immigration judges have exclusive jurisdiction over asylum applications filed by someone served a Notice to Appear after the charging document is filed.

Ending a case is not the same as a ruling on whether you qualify for asylum. The rules say that, except as provided in paragraph (b) or (c), USCIS has initial jurisdiction over the matters listed in 8 C.F.R. § 1208.2, and that section does not say what a judge’s decision includes or how it ends. That order can direct removal, the termination of proceedings, or another disposition. 8 C.F.R. § 1240.12 sets out this structure.

Check the order’s exact wording, line by line, before you decide anything. A summary or a status line on a case website can be incomplete.

If a referral notice or a dismissal order has you unsure what comes next, you don't have to sort it out alone. This happens when the applicant appears inadmissible or deportable. 8 C.F.R. § 1208.14 says the asylum officer then refers the application to an immigration judge with the appropriate charging document. The same rule allows an application to be dismissed by the asylum officer where charging documents may not be issued. That is a different step from a judge’s order.

8 C.F.R. § 1239.1 explains this start point. Your court notice, your USCIS account, and your notice to appear may list different dates or case numbers. Put them side by side. Write down which agency issued each one.

Dismissal Versus Termination: Why the Label Matters

Dismissal and termination are both common words for ending a case. The label you hear from someone else may not match the order you received. The judge’s order is the document that counts.

8 C.F.R. § 1240.12 says an order can direct removal, the termination of proceedings, or another disposition. It also lets the judge issue orders in the alternative or in combination. So one order can contain more than one result. Read every line of the disposition, not just the first heading.

The label affects what you do next. Ask the office how the exact wording applies before you file any new form with USCIS or the court.

Common Ways a Case Can End or Pause in Court

A party can ask the judge to end or pause a case, and the judge decides under the rules for that request. The request must be in writing and must state its grounds clearly. 8 C.F.R. § 1003.23 requires pre-decision motions to state the grounds with particularity, the relief sought, and the jurisdiction.

Which request fits depends on the facts of your case. Under 8 C.F.R. § 1003.23, the immigration judge has discretion to deny a motion to reopen even if the moving party has established a prima facie case for relief. Under 8 C.F.R. § 1003.23, motions submitted before a final order must generally be in writing and state their grounds, the relief sought, and the jurisdiction, unless the immigration judge permits otherwise. Our naturalization page covers that work.

Administrative closure is another request, and it is covered in the next section. For background on the court process, see our removal defense page.

Administrative Closure and Other Outcomes That Are Not Final

Administrative closure takes a case off the court’s active calendar, and the case can be brought back later. Under 8 C.F.R. § 1003.18, a judge may administratively close a case on a party’s motion. The rule also refers to recalendaring, which means returning the case to the calendar.

The standard depends on who asks. If both parties file jointly, or one files and the other says it does not oppose, the judge must grant the motion. The judge can deny it only for unusual, clearly identified, and supported reasons. In other cases, the judge weighs the totality of the circumstances. No single factor decides the question.

Get the outcome in writing. Ask whether your case is closed, pending, or ended, and keep the order that says so. Keep copies of every order and motion. Track the case in both the court’s records and your USCIS account.

What Happens to the Asylum Application After the Case Ends

How the case ended shapes what happens to the asylum application. Family members are often the biggest worry. 8 C.F.R. § 1208.14 says a denial of a principal applicant’s asylum application also denies asylum status to dependents listed on that same application. But a dependent who is otherwise eligible and has filed a separate asylum application is not precluded from a grant of asylum by that denial.

Before you file any new form, ask about the current filing steps for your case. Forms and instructions can change, and a wrong filing can cost time.

Later applications can also be affected by how a case ended. Our adjustment of status and naturalization pages cover those applications. Map out what each order says before you file them.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

Deadlines to Watch and How an Appeal Works

In no case may the judge grant asylum without compliance with the requirements of 8 C.F.R. § 1003.47 concerning identity, law enforcement, or security investigations or examinations. 8 C.F.R. § 1003.38 says the Notice of Appeal, Form EOIR-26, must be filed directly with the Board of Immigration Appeals within 10 calendar days of the Immigration Judge’s decision, or within 30 calendar days in certain asylum cases where the judge adjudicated the asylum application and did not deny it under INA 208(a)(2)(A), (B) or (C). The clock starts from the oral decision, or from mailing or electronic notice of a written decision. If the last day is a weekend or legal holiday, the deadline moves to the next business day.
