A lawyer enters an appearance by filing Form EOIR-28 with the court. That filing makes the lawyer your representative in the case. This page explains what that filing means, what happens after it, and what the judge reviews.

An asylum referral moves your case into immigration court

An asylum referral usually sends your case from the asylum office to an immigration judge. When an asylum officer finds that an applicant appears inadmissible or deportable, except for applicants described in paragraph (c)(4)(ii) of this section who have not already been subject to proceedings in accordance with 8 CFR 235.3, the officer refers the application to an immigration judge with the charging document, or, where charging documents may not be issued, dismisses the application (8 CFR § 1208.14).

The asylum office stage is a review by an officer. The court stage is a case before a judge. The referral does not decide your case. The judge hears your claim at a hearing and decides it there.

The charging document is usually a Notice to Appear. It must tell you that you may be represented by counsel. It also tells you that you must immediately give the government a written record of an address and telephone number where you can be reached, and must immediately give it a written record of any change in that address or telephone number (8 U.S.C. § 1229).

If a notice and a court date have arrived, the timeline can feel very short. Read every date and keep every paper. Missing a hearing can have serious results, as explained below.

If a court date you didn't expect has your family worried, our team can talk through the notice with you. The lawyer then becomes the practitioner of record. That lawyer is required to appear in court for you, file documents for you, and accept service of court papers (8 CFR § 1003.17).

The form also states the scope. It can cover all proceedings, custody and bond proceedings only, or all proceedings other than custody and bond. The lawyer stays on the case until the judge allows withdrawal or substitution.

In practice, representation covers several tasks:

Preparing and filing your application and supporting papers

Attending master calendar and individual hearings

Speaking with the government attorney about your case

Presenting your testimony, witnesses, and evidence

Some help is more limited. Under 8 C.F.R. § 1003.17, a practitioner who assists a pro se respondent with drafting, completing, or filling in blank spaces of a specific motion, brief, form, or other document intended for filing with the immigration court must disclose that limited assistance to the court using Form EOIR-61, unless the practitioner has filed Form EOIR-28 to become the practitioner of record. That lawyer is not the practitioner of record and does not appear in court for that person (8 CFR § 1003.17).

Asylum is not the only relief the judge may consider. An immigration judge may decide both an asylum claim and a request for withholding of removal, whether or not asylum is granted (8 CFR § 1208.16). For applications filed on or after April 1, 1997, an applicant found ineligible for asylum under either section 208(a)(2) or 208(b)(2) of the Act is still considered for eligibility for withholding of removal under section 241(b)(3) of the Act. For applications filed on or after April 1, 1997, the applicant is also considered for Convention Against Torture protection if the applicant requests it or if the evidence indicates the applicant may be tortured in the country of removal (8 CFR § 1208.13).

How representation works, step by step

Representation follows a set of steps that begin with the papers you already have. The schedule depends on the court’s docket and your case, so each step is confirmed for your situation.

Gather your papers. Bring the Notice to Appear, the asylum referral, prior filings, and every court date you have.

Review deadlines. The general asylum filing period is one year. It is counted from your last arrival in the United States, or April 1, 1997, whichever is later. In immigration court, the application counts as filed on the day the court receives it. Exceptions exist, and the judge decides whether one applies (8 CFR § 1208.4).

File Form EOIR-28 and confirm the schedule. The filing makes the representation official. The first hearing cannot be set earlier than 10 days after the Notice to Appear is served, unless you ask in writing for an earlier date (8 U.S.C. § 1229).

Attend the master calendar hearing. The judge requires you to admit or deny the factual allegations and removability (8 CFR § 1240.10). In a deportability case, the government must prove removability by clear and convincing evidence (8 CFR § 1240.8).

Prepare for the individual hearing. This step covers declarations, country conditions evidence, and witness preparation. Start this work early, not the week of the hearing.

What the court looks for in an asylum claim

The court looks for proof that you qualify as a refugee, and it weighs whether your testimony is credible. The applicant carries the burden of proof. Your testimony alone can be enough if the judge finds it credible (8 CFR § 1208.13).

When a judge asks for evidence that backs up credible testimony, you must provide it. The exception is when you do not have it and cannot reasonably obtain it (8 U.S.C. § 1158).

The judge looks at the whole picture. That includes whether your written and spoken statements match and whether your account is plausible. A judge may weigh an inconsistency even when it does not go to the heart of the claim (8 U.S.C. § 1158).

Certain legal bars can block asylum. For applications filed on or after April 1, 1997, an applicant does not qualify for asylum if section 208(a)(2) or 208(b)(2) of the Act applies. Certain mandatory denial grounds, those in paragraphs (c)(10)(i) and (ii) of this section, do not apply to an applicant seeking asylum or withholding of removal in the United States upon return from Canada under the Agreement Between the Government of the United States and the Government of Canada for Cooperation in the Examination of Refugee Status Claims from Nationals of Third Countries (8 CFR § 1208.13).

Common questions about immigration court representation

Representation organizes a process with many moving parts.
