Certain asylum decisions get 30 days instead, under narrow conditions. If you’re wondering how long to appeal immigration judge decision BIA rules allow, start by finding the date of the decision.

How Many Days Do You Have to Appeal to the BIA?

The general deadline is 10 calendar days, and the rule applies to the Notice of Appeal itself. 8 CFR 1003.38 requires the Form EOIR-26 to reach the Board within that window. If the last day falls on a Saturday, Sunday, or legal holiday, the deadline moves to the next business day.

The 30-day window is narrower. It applies only where the judge adjudicated an asylum application and did not deny it under specific bars in the Immigration and Nationality Act. Don’t assume 30 days applies just because your case feels serious.

Start with the decision itself. Note whether the judge ruled in court or in writing, and write down the date. If you’re helping a relative who was just in court, record that date today, before the paperwork gets buried.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

When Does the Clock Start for an Oral or Written Decision?

The clock starts on the day the judge states an oral decision, or on the day a written decision is mailed or sent electronically. 8 CFR 1003.38 sets that rule. An oral decision is stated in front of you and DHS counsel at the end of the hearing, under 8 CFR 1240.13.

A written decision works differently. Service by mail is complete upon mailing, so the mailing date matters more than the day the envelope reaches your home. A written copy is not sent to a person who has not provided a written address, so confirm the address the court has on file under 8 CFR 1003.37.

To count forward, find the date the decision was stated or the date on the mailing or service paperwork. Then count 10 calendar days from that date, and check whether a weekend or holiday moves the deadline.

Does the 10-Day Rule Cover Every Removal Decision?

Not every order can be appealed to the BIA. 8 CFR 1240.15 says an appeal lies to the Board from an immigration judge decision, “except that no appeal shall lie from an order of removal entered in absentia.” If you were ordered removed after missing a hearing, that appeal route is closed.

A decision by a DHS officer follows a different track. An appeal of that decision goes on Form EOIR-29, filed with the DHS office within 30 days of service under 8 CFR 1003.3.

Until you confirm which type of decision you have, mark the earliest possible date on your calendar.

What Counts as Filing, and What Does It Cost?

Your appeal counts as filed on the day the Board receives it, not the day you mail it. 8 CFR 1003.38 ties filing to receipt by the Board. An appeal is not properly filed unless the Board receives it, with all required documents, the fee or fee waiver request, and proof of service, within the time allowed under 8 CFR 1003.3.

A filing fee, or a fee waiver request, is generally required under 8 CFR 1003.8, with exceptions such as custody bond appeals, and the amount is set in 8 CFR 1103.7(b). Confirm the current amount and the payment method before you file, since fees can change.

Filing fees are set in [8 CFR 1103.7] when a fee is required pursuant to 8 CFR 1003.8. A fee waiver request on Form EOIR-26A, signed under penalty of perjury, is governed by 8 CFR 1003.8, and the Board may waive a fee only upon a showing that you are unable to pay.

Serve a copy on the opposing party, and keep proof of that service.

Which Issues Must Appear in the Notice of Appeal?

Every issue you want the Board to review must be raised in the Notice of Appeal itself. 8 CFR 1003.38 treats any issue not raised there as waived. 8 CFR 1240.15 also requires the reasons for the appeal to be stated in the notice, and missing reasons can lead to dismissal.

Name each ruling you disagree with, in plain terms, and state why. Don’t count on adding reasons later.

What Happens After You File the Notice?

Some appeals are dismissed early, without full review. Those dismissals come in a written order.

If the appeal moves forward, briefs follow a schedule. For appeals where no transcript is warranted, both sides file briefs within 20 days of the Board’s briefing order, and no more than 35 days after the appeal was filed, under 8 CFR 1003.3. Extensions of the briefing schedule are granted only as a matter of the Board’s discretion, and only in exceptional circumstances. Workload concerns, travel plans, or similar concerns within the control of either party or their representatives do not constitute exceptional circumstances.

Keep every Board order and date in one place, because briefing deadlines run from those orders.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a consultation

Schedule a consultation

What Happens If the Deadline Passes?

If no timely appeal is filed, the judge’s decision becomes final.
