The lawyer reviews the charges, files court papers, and appears with you at hearings. AG Immigration Law P.A. focuses on removal defense. This page explains how that work moves from the first notice to a possible appeal.

What a Deportation Defense Lawyer Does in Immigration Court

A deportation defense lawyer represents a noncitizen in removal proceedings, the court process that decides whether a person must leave the United States. Most cases start with a Notice to Appear. The notice must be given to you in person, or, if personal service is not practicable, by mail to you or your lawyer of record. It must list the acts alleged, the charges, and the laws said to be violated.

The notice also tells you that you may have a lawyer. You are entitled to time to find one.

This work fits people who have a Notice to Appear, a court date, a detention problem, or a removal order they want to challenge. Adriana Gomez is the lawyer responsible for this page. Our team, including support staff, helps with filings, scheduling, and deadline tracking.

If a Notice to Appear just arrived and your hearing date is coming up, our team can review your case with you and explain your options. Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

What Removal Defense Covers

Removal defense means challenging the charges and asking the court for relief that could let you stay. Common parts of the work include:

  • Responding to the charges. Your lawyer answers the allegations and charges in the notice.
  • Cancellation of removal. Federal law lets the Attorney General cancel removal for some people who meet specific requirements.
  • Adjustment of status and waivers. These paths depend on your immigration history and family ties.
  • Bond and detention issues. Bond requests go to the immigration court, as explained below.
  • BIA appeals. An appeal of the judge’s decision goes to the Board of Immigration Appeals.

Which relief is available depends on the facts of each case. We review your facts before recommending a path.

How the Removal Process Works, Step by Step

A removal case usually moves from the notice to a master calendar hearing, then to an individual merits hearing. It may end in a Board appeal.

  1. Review. We review your notice, past filings, and immigration history. The first hearing cannot be set earlier than 10 days after the notice is served, unless you ask for an earlier date in writing (8 U.S.C. § 1229).
  2. Appearance. Your lawyer files Form EOIR-28 to become the practitioner of record (8 CFR 1003.17).
  3. Master calendar hearing. The judge takes your responses and sets deadlines for applications and evidence.
  4. Preparation. We prepare applications, evidence, and witness support.
  5. Individual merits hearing. The judge decides and gives reasons. The decision may be oral or written (8 CFR 1240.12).
  6. Appeal. A Board appeal starts with Form EOIR-26, filed directly with the Board. The deadline runs from the date an Immigration Judge states an oral decision, or from the mailing or electronic notification of a written decision (8 CFR 1003.38).

Timelines depend on the court’s schedule and your case.

Immigration Court Hearings and Detention in South Florida

Hearings are a central part of a removal case, and our team can explain what to expect at each one. Missing one can lead to an order entered without you.

If the person fails to appear, the judge shall order removal in absentia if the government proves by clear, unequivocal, and convincing evidence that the person is removable and that written notice of the time and place of proceedings and of the consequences of failure to appear was provided. Notice sent to your most recent address counts, and if you did not provide your address, no written notice is required (8 CFR 1003.26).

Detention cases follow their own steps. A bond request is directed to the Immigration Judge. It goes to the immigration court that has jurisdiction over the detention location (8 CFR 1003.19).

Families searching for a detained relative can use the ICE Online Detainee Locator System. Our removal work covers Florida, including Miami, Broward County, and Orlando.
