Renewing Your Work Permit While Your Case Is in Court

A pending immigration case does not have to leave you without work authorization. Learn how renewals work and when to act, with guidance from Adriana Gomez and the AG Immigration Law team.

A work permit renewal during immigration court is filed with USCIS, not with the judge. Your pending removal case does not stop you from asking for a new Employment Authorization Document (EAD), the card that shows you may work. Timing, your eligibility category, and any change in your case can still affect whether your card stays valid. Here are the questions people ask most, answered in plain terms.

Can a Work Permit Renewal Be Filed While the Case Is Pending?

Yes. A pending case does not by itself bar a renewal request. The request goes to USCIS on the form it designates, with any required fees, under 8 CFR 274a.13. The rule also allows a renewal to be filed alongside a related benefit request that, if granted, would form the basis for eligibility for employment authorization, but only where the form instructions or USCIS announcements permit it.

Keep these papers together: the expiring card, the receipt notice, your hearing notices, and a short list of key dates. If USCIS or an employer asks questions, those papers show your timeline in one place.

Eligibility still depends on your category. Two people with the same court date can have very different renewal rules.

If your work permit is close to expiring while your case is still in court, you do not have to sort out the dates alone, and our team is glad to talk it through with you. Why Doesn’t the Immigration Court Control My Renewal?

The immigration court controls your removal case, not your work permit application. The court schedules cases and gives notice of the time, place, and date of hearings, as 8 CFR 1003.18 explains. A hearing date and a renewal request follow two separate tracks.

A common mistake is assuming the court will handle the renewal. People sometimes wait for the hearing and miss the USCIS filing window. Keep the two tracks in view at all times.

Asking the court to act on your case is a different question. A judge may grant a motion, such as administrative closure, and that can change how the case moves. Because that choice affects the whole case, think it through before you file anything.

How Long Does USCIS Take to Renew a Work Permit?

There is no single answer, because processing time depends on the form, the filing location, and whether USCIS asks for more evidence. The wait depends on the details in your file, not on one fixed date.

Your category matters too. Asylum applicants face extra timing rules, which we cover below. Processing times can change, so plan around your card’s expiration date rather than a guessed wait.

The receipt notice is your proof that USCIS received your request. Keep it with the card and any later notices. It shows the date you filed, which you will need if you ever have to explain a timeline to an employer or a court.

Filing early leaves more room before a gap begins.

What Happens If My Work Permit Expires While the Renewal Is Pending?

An expired card can leave a gap in your work authorization. Whether an extension applies depends on your category and filing date.

DHS changed the rules in 2025. For renewals filed on or after October 30, 2025, a timely filed request for renewal will not be automatically extended under 8 CFR 274a.13(e). The automatic extension in 8 CFR 274a.13(d) applies only where a renewal request meets all of the criteria in (d)(1)(i) through (iii). The change applies to renewal applications filed on or after October 30, 2025, and does not apply where the law or paragraph (d) of this section provides otherwise, or where an applicable Federal Register notice regarding procedures for renewing TPS-related employment documentation provides otherwise.

Some categories also end on their own. Under 8 CFR 274a.14, employment authorization in certain categories ends automatically when exclusion or deportation proceedings are instituted. The rule does not bar that authorization where appropriate.

Employers may ask for updated documents. Show them the card, the receipt, and the rule that applies to your category, and keep a copy of each.

Does an Administratively Closed Case Affect My Work Permit?

Administrative closure pauses a removal case on the court’s calendar. A judge can later return the case to the calendar, which is called recalendaring, pursuant to a party’s motion and in the exercise of discretion. Under 8 CFR 1003.18, an immigration judge may grant administrative closure on a party’s motion, using discretion.

A judge must grant a motion to administratively close or recalendar filed jointly by both parties, or filed by one party where the other party has affirmatively indicated its non-opposition, unless the judge articulates unusual, clearly identified, and supported reasons to deny it. In other cases, the judge weighs the whole situation, and no single factor controls. The rule also lists the person’s ICE detention status as a factor the judge may weigh.

For your work permit, closure does not settle the question by itself. Review the case status and that basis before you file a renewal.

Does the Asylum Clock Change My Renewal?

Yes, asylum applicants face their own timing rules.

Renewals have a deadline too. Under 8 CFR 208.7, for asylum-based employment authorization to be renewed before it expires, the renewal must be received 90 days before the current authorization expires. Each renewal also carries a fee of at least $275, and under 8 U.S.C. 1810 that fee cannot be waived.

The asylum case itself matters as well. Under the same regulation, if the Board of Immigration Appeals denies an appeal of an asylum denial, employment authorization ends immediately.

Asylum and EAD rules are technical. Check each date against your own paperwork.

Can ICE Arrest Someone Who Has a Work Permit?

No. A work permit does not protect you from arrest or removal proceedings.

The law allows arrest and detention on a warrant while a removal decision is pending, as 8 U.S.C. 1226 provides. Under 8 U.S.C. § 1226(a)(3), the government may not provide work authorization to a person arrested pending a removal decision unless that person is lawfully admitted for permanent residence or would otherwise be provided such authorization without regard to removal proceedings. Your detention status and case history shape what happens next, not the card alone.

A missed hearing can be serious too. Under 8 U.S.C. 1229a, a person who does not attend after proper written notice shall be ordered removed in absentia if the government establishes by clear, unequivocal, and convincing evidence that the notice was provided and that the person is removable. In some cases, where the person was given oral notice, in a language they understand, of the time and place of the proceedings and of the consequences of failing to attend, that order can block certain relief for 10 years, unless exceptional circumstances apply.
